Capital Maintenance Contract definition

Capital Maintenance Contract or “CMC” means the Capital Maintenance Agreement and the CMA General Conditions.
Capital Maintenance Contract has the meaning set forth in Section 1.2 of the Capital Maintenance Agreement. Documents or CMC Documents Code has the meaning set forth in Recital A to this DBA. Contract Documents has the meaning set forth in Section 1.3 of this DBA. DB Contractor or Design-Build means , a , together with its successors and Contractor assigns. Design-Build Agreement has the meaning set forth in the preamble hereof. Design-Build Special Provisions or means Design-Build Special Provisions to Items 10-28. Special Provisions Design-Build Specifications means the Design-Build Standard Specifications, Items 10-28, as modified by the Special Provisions and the CMA Standard Specification Item 9.

Examples of Capital Maintenance Contract in a sentence

  • Prior to execution of this Capital Maintenance Contract, DB Contractor delivered to TxDOT one copy of all cost, unit pricing, price quote and other documentary information used in preparation of the Maintenance Price (the “EPDs”).

  • Alternatively, TxDOT may deduct the amount of such costs and expenses from any sums owed by TxDOT to DB Contractor pursuant to this Capital Maintenance Contract.

  • The EPDs associated with any Change Order or Maintenance Price adjustment under this Capital Maintenance Contract shall be reviewed, organized and indexed in the same manner described in the ITP.

  • DB Contractor shall procure and keep in force, or cause to be procured and kept in force, prior to performing any work under the Capital Maintenance Contract across, under or adjacent to the railroad’s tracks or railroad right-of-way, railroad protective liability insurance policy with limits and coverage terms and conditions as required by the operating railroad with the railroad as the named insured.

  • Any insurance or self- insurance beyond that specified in this Capital Maintenance Contract that is maintained by an insured or any such additional insured shall be in excess of such insurance and shall not contribute with it.
