Buyer Bid Curtailment definition

Buyer Bid Curtailment means the occurrence of all of the following:
Buyer Bid Curtailment means Buyer as SC communicates a curtailment instruction to the Seller, requiring Seller to produce less Energy from the Project than the CAISO final market forecast amount to be produced from the Project for a period of time, and Buyer as the SC either (a) submitted a CAISO final market Energy Supply Bid and such curtailment is solely a result of the CAISO implementing the Energy Supply Bid; or (b) submitted a CAISO final market Self-Schedule for less than the amount of the final-market Energy forecasted to be produced from the Project. However, if the Project is subject to a Planned Outage, Forced Outage, Force Majeure and/or a Curtailment Period during the same period of time, then Buyer Bid Curtailment shall not include any Energy that is subject to such Planned Outage, Forced Outage, Force Majeure or Curtailment Period.
Buyer Bid Curtailment means the occurrence of all of the following: (a) the CAISO orders, directs, or provides notice to a party, which has the effect of requiring the Party to produce less Energy from the Project than capable of being and expected and forecasted to be produced from the Project for the applicable time period; (b) Buyer or Buyer’s SC did not submit a Self-Schedule or Energy Supply Bid for the MWh subject to the reduction, or Buyer or Buyer’s SC submitted an Energy Supply Bid and such Energy Supply Bid resulted in a Schedule that was less than the amount of Energy capable of being and expected and forecasted to be produced by the Project for the same period of time; and (c) no other circumstances exist that constitutes a Force Majeure and/or a Curtailment Period.

Examples of Buyer Bid Curtailment in a sentence

  • For the avoidance of doubt, a Buyer Curtailment Order, Buyer Bid Curtailment or Curtailment Order communication via such systems and facilities shall have the same force and effect on Seller as any other form of communication.

  • Seller agrees to reduce the Project’s generation by the amount and for the period set forth in the Buyer Curtailment Order, Buyer Bid Curtailment or Curtailment Order.

  • Seller shall be liable pursuant to Section 3.1(p)(ii) for failure to comply with a Buyer Curtailment Order, Buyer Bid Curtailment or Curtailment Order, during the time that Seller’s facilities, communications links or other equipment, protocols or practices are not in compliance with then-current methodologies.

More Definitions of Buyer Bid Curtailment

Buyer Bid Curtailment means Buyer as SC or through its Third-Party SC communicates a curtailment instruction to the Seller, requiring Seller to produce less Energy from the Project than the CAISO final market forecast amount to be produced from the Project for a period of time, and Buyer as the SC or through its Third-Party SC either (a) submitted a CAISO final market Energy Supply Bid and such curtailment is solely a result of the CAISO implementing the Energy Supply Bid; or
Buyer Bid Curtailment means the occurrence of all of the following: the CAISO provides notice to a Party or the Scheduling Coordinator for the Facility, requiring the Party to deliver less Facility Energy from the Facility than the full amount of energy forecasted in accordance with Section 4.3 to be produced from the Facility for a period of time; for the same time period as referenced in (a), the notice referenced in (a) results from the manner in which Buyer or the SC schedules or bids the Facility or Facility Energy, including where Buyer or the SC for the Facility: did not submit a Self-Schedule or an Energy Supply Bid for the MW subject to the reduction; or submitted an Energy Supply Bid and the CAISO notice referenced in (a) is solely a result of CAISO implementing the Energy Supply Bid; or submitted a Self-Schedule for less than the full amount of Facility Energy forecasted to be generated by or delivered from the Facility. If the Facility is subject to a Planned Outage, Forced Facility Outage, Force Majeure Event or a Curtailment Period during the same time period as referenced in (a), then the calculation of Deemed Delivered Energy in respect of such period shall not include any Energy that was not generated due to such Planned Outage, Forced Facility Outage, Force Majeure Event or Curtailment Period.
Buyer Bid Curtailment means the occurrence of all of the following: (a) the CAISO orders, directs, or provides notice to a Party, which has the effect of requiring the Party to produce less Energy from the Project than capable of being and expected and forecasted to be produced from the Project for the applicable time period; (b) Buyer or Buyer’s SC did not submit a Self-Schedule or Energy Supply Bid for the MWh subject to the reduction, or Buyer or Buyer’s SC submitted an Energy Supply Bid and such Energy Supply Bid resulted in a Schedule that was less than the amount of Energy capable of being and expected and forecasted to be produced by the Project for the same period of time; and (c) no other circumstances exist that constitutes a Force Majeure and/or a Curtailment Period.
Buyer Bid Curtailment means any curtailment of the Facility arising out of or resulting from the manner in which Buyer bids, offers or schedules the Facility, the Energy or any Products, or in which Buyer fails to do so, including a situation where all of the following occurs:
Buyer Bid Curtailment means the occurrence of all of the following:(a)the CAISO provides notice to a Party or Buyer’s SC, requiring the Party to produce less Energy from the Generating Facility than forecasted to be produced from the Generating Facility for a period of time; (b)for the same time period as referenced in (a), Buyer or Buyer’s SC: (i)did not submit a Self-Schedule or an Energy Supply Bid for the MW subject to the reduction; or(ii)submitted an Energy Supply Bid and the CAISO notice referenced in (a) is solely a result of CAISO implementing the Energy Supply Bid; or (iii)submitted a Self-Schedule for less than the full amount of Energy forecasted to be produced from the Generating Facility; and (c)no other circumstances exist that constitute a Scheduled Maintenance Outage, Forced Outage, Force Majeure and/or a Curtailment Period during the same time period as referenced in (a).

However, if the Project is subject to a Planned Outage, Forced Outage, Force Majeure and/or a Curtailment Period during the same period of time, then Buyer Bid Curtailment shall not include any Energy that is subject to such Planned Outage, Forced Outage, Force Majeure or Curtailment Period.
Buyer Bid Curtailment means the occurrence of all of the following: (1) the CAISO orders, directs, alerts or provides notice to a Party, which has the effect of requiring the Party to reduce Energy production from the Project to a level lower than the amount of Energy forecasted to be produced by the Project for the same period of time as determined reasonably by Buyer using the information provided pursuant to Section 3.1(l) and as otherwise provided under this Agreement; (2) Buyer or Buyer’s SC did not submit a Self-Schedule or Energy Supply Bid (or equivalent action under a revised CAISO Tariff) for the MWh subject to the reduction, or Buyer or Buyer’s SC submitted an Energy Supply Bid (or equivalent action under a revised CAISO Tariff) and such Energy Supply Bid (or equivalent action under a revised CAISO Tariff) resulted in a Schedule that was less than the amount of Energy forecasted to be produced by the Project for the same period of time as determined reasonably by Buyer using the information provided pursuant to Section 3.1(l) and as otherwise provided under this Agreement; and (3) no other circumstances exist that constituted a Curtailment Period.
