Buy American definition

Buy American means the Buy American provision as described in Section 12(n) of the National School Lunch Act which requires schools participating in the National School Lunch Program (NSLP) to purchase, to the maximum extent practicable, domestic commodities and products. A domestic commodity or product means an agricultural commodity that is processed in the United States, and a food product that is processed in the United States substantially using agricultural commodities that are produced in the United States. Purchases made in accordance with the Buy American provision must still follow the applicable procurement rules calling for free and open competition. Any entity that purchases food or food products on behalf of the SFA must follow the same Buy American provisions that the SFA is required to follow.
Buy American. ’ certificate means a certification that the contractor has complied with the ‘‘Buy American’’ re- quirement (see § 1726.15).
Buy American provisions do not apply.

Buy American. Provision. The FSMC shall purchase foods that meet all Buy American Provision regulations as described in 7 CFR 210.21(d) and FNS Policy Memo SP 38- 2017.
