Business Agreement definition

Business Agreement means collectively, the agreements entered into by the successful tenderer with any person or entity for any transactions, businesses or trades (including without limitation, for the sale of any goods and/or services by the successful tenderer) made at, in, on or from the said premises (or any part thereof) or in respect of the said premises (or any part thereof) or from the successful tenderer’s operations associated with the said premises (or any part thereof) that would in the normal course or in accordance with normal accounting practice be credited or attributed as income or revenue of the successful tenderer’s business at the said premises (such agreements to exclude the Subletting Agreements), and “Business” means collectively, such transactions, businesses or trades (excluding Subletting);
Business Agreement means any contract, agreement, real or personal property lease, commitment, understanding, or instrument (other than the Retained Agreements) to which Seller (or, with respect to the Additional Real Property, Building Seller) is a party, whether oral or written, that relates principally to the Business, the Purchased Assets, or the Assumed Obligations.
Business Agreement means each indenture, mortgage, deed of trust, contract, undertaking, agreement, lease, easement or other instrument to which any Subject Company is or becomes a party or by which any Subject Company, any Subject Company Property or any Subject Company’s Equity Interests are or become bound or to which any Subject Company, any Subject Company Property or any Subject Company’s Equity Interests are or become subject.
