Bona Fide Leave definition

Bona Fide Leave means a “bona fide leave of absence” within the meaning of that term under Section 409A-1(h)(1)(i) of the Treasury Regulations promulgated pursuant to Section 409A of the Code.
Bona Fide Leave means a "bona fide leave of absence" from the Company and the Affiliated Employers as defined in Section 409A-1(h)(1)(i) of the Code and the regulations thereunder.
Bona Fide Leave means a “bona fide leave of absence” from the Company and the Affiliated Employers as defined in Treasury Regulation Section 1.409A-1(h)(1)(i).

Examples of Bona Fide Leave in a sentence

  • Notwithstanding the foregoing, if, prior to January 20, 2014 and at a time that a Participant is on a Bona Fide Leave, an Acceleration Event occurs with respect to such Participant or such Participant’s employment terminates due to Retirement, such Participant shall be entitled to payments, if any, under the Plan in accordance with Section 6.02 or 6.03, as applicable.

  • Military Leave, Sick Leave and Grantee's Bona Fide Leave of Absence.

  • Bona fide means a licensed fishing boat marked with its licensed fishing boat number, with a fishing crew who hold commercial fishing licences;

  • Parental leave means leave to bond and to care for a newborn child after birth or to bond and care for a child after placement for adoption or xxxxxx care, for a period of up to sixteen (16) weeks after the birth or placement.

  • Approved Leave of Absence means an absence from active service pursuant to an approved leave policy with a guaranteed right of reinstatement.

  • Bona Fide Offer means an actual or genuine offer which includes a specific wage or a training opportunity at a specified place when used to determine whether the parent has refused an offer of training or employment.

  • Bad Leaver means, unless otherwise specified herein, (i) the Owner's ceasing to be a member of the executive management or an employee of the Company or a subsidiary due to the Owner being dismissed because of the Owner's breach of the employment relationship or (ii) the Owner's ceasing to be an employee of the Company or a subsidiary due to being dismissed during the probationary period applicable to the Owner or not being offered continuous employment after the expiry of the probationary period applicable to the Owner. The Owner’s employment shall in case of dismissal be deemed ceased at the time the notice of termination served by the Company or a subsidiary to the Owner expires.

  • Authorized leave of absence means an unpaid, temporary cessation from active employment with the Employer pursuant to an established nondiscriminatory policy, whether occasioned by illness, military service, or any other reason.
