  • Notwithstanding any provision to the contrary, to the extent Trustwave provides any beta Test Products: (a) such Beta Test Products are provided to Customer “as-is” and with all faults, and Trustwave will not provide any maintenance or support services for Beta Test Products; (b) Trustwave disclaims any and all warranties with respect to Beta Test Products, and (c) Trustwave will not have any liability whatsoever with respect to Beta Test Products.

Beta Test means the successful testing of the systems and technologies provided by the Corporation to logistically support the Mall (as defined in the Marketing Agreement) as reasonably determined by Investor; (ii) "Electronic Commerce Tools" shall have the meaning set forth in the Marketing Agreement; (iii) "Mall Tenant" shall have the meaning set forth in the Marketing Agreement; (iv) "Subscribers" shall mean all Mall Tenants that Investor and any of its affiliates or Alliances participated in soliciting; and (iv) "Warrant Term" shall mean the term beginning on the Closing Date and ending on the earlier of (A) the second anniversary of the date of completion of the Beta Test and (B) the date of issuance of the Warrant.

(Game License) of the agreement. “Guest Pass”means a code which can be made available to the user when the user purchases the Game. This code can be given by the user to another person, allowing this person to access the Game for a certain amount of time. “Party” means the user or Pathea Games, both together referred to as the “Parties”. “Privacy Policy” means the privacy policy applicable to the personal data collected from the user in the services and processed by Pathea Games. “Release” means the date as from which the game will be made available to the user as a final product. New content and/or updates and upgrades of the game may be added to the game after the release by Pathea Games. “Services” means the services provided to the user by Pathea Games, free of charge or for a fee, including the Website, the Forums, the Game, the Shop, and through partnering third party outlets such as Steam.. “Territory” means serviced countries of Asia, Europe, North America and Oceania.
