Average Selling Price definition

Average Selling Price means the total amount, in dollars (based upon the first sale to arms-length customers), for a device, sensor, accessory or other product divided by the number of devices, sensors, accessories or other products sold during the relevant period, or quarterly if not otherwise stated, on a product-by-product basis.
Average Selling Price means, with respect to each Product, the price per Unit of Product determined for a given Sales Year or Residual Year by dividing the Net Sales of such Product for such year by the Net Units of such Product for such year.
Average Selling Price means the Net Sales of any given Product divided by the total number of units of that Product shipped (excluding non-revenue units, such as samples) and invoiced by Abbott or its Affiliates to Customers.

More Definitions of Average Selling Price

Average Selling Price means the average of net revenue actually received by Xxxxxx Xxxxxx from end users on sales of such RF generators in each calendar quarter during the term of this Agreement. As used in the previous sentence, "net revenue" shall equal the total gross revenue, less credits or allowances on account of rejections of RF generators previously sold upon which a royalty has already been made to Somnus. In the event that Xxxxxx Xxxxxx places such RF generators with end users at no cost, Xxxxxx Xxxxxx shall pay Somnus a royalty based on the average selling price of [*] per unit.
Average Selling Price means the weighted average selling price, based on the invoice price less discounts, of Licensee Products that include Licensed Technology, sold by Licensee during the applicable calendar quarter.
Average Selling Price means, for each Albunex Product which is sold during any calendar quarter, the quotient obtained by dividing (i) the Net Sales of that Albunex Product during the quarter by (ii) the number of vials of that Albunex Product shipped to purchasers during the quarter (including vials given away in order to provide a discounted purchase price and vials distributed as samples, but not including vials shipped at no charge for preclinical and clinical trials). The Average Selling Price for each Albunex Product which is labeled in a manner that permits vials of that product to be sold in more than one country shall be determined on a sales-weighted basis by taking into account the aggregate Net Sales of that Albunex Product in all such countries during the quarter (i.e., the Average Selling Price shall not be determined by averaging the Average Selling Price for each such country).
