Authorized Containers definition

Authorized Containers means containers of certain types, sizes, shapes and other distinguishing characteristics that Company from time to time approves in its sole discretion, subject to Section 12.9, for use by all Regional Producing Bottlers in manufacturing Authorized Covered Beverages at the Regional Manufacturing Facilities. A list of Authorized Containers for each Authorized Covered Beverage will be provided by Company to Bottler, which list may be amended by additions, deletions or modifications by Company from time to time in its sole discretion.

  • The Bottler hereby acknowledges the personal nature of the Bottler's obligations under this Agreement with respect to the performance standards applicable to the Bottler, the dependence of the Trademarks on proper quality control, the level of marketing effort required of the Bottler to increase demand for the Beverages in Authorized Containers, and the confidentiality required for protection of the Company's trade secrets and confidential information.

  • The Company hereby authorizes the Bottler, and the Bottler undertakes, subject to the terms and conditions contained herein, to prepare and package the Beverages in Authorized Containers, as defined hereinafter, and to distribute and sell the same under the Trade Marks, in and throughout, but only in and throughout, the territory which is defined and described in Appendix III (hereinafter referred to as the “Territory”).

  • By this Agreement, the Company extends to the Bottler only: (i) a nonexclusive license to use the trademark "Pepsi-Cola" as part of the corporate name of the Bottler; and (ii) an exclusive license to use the Trademarks solely in connection with the manufacture, packaging, distribution, and sale of the Beverages in Authorized Containers in the Territories subject to the rights reserved to the Company under this Agreement.

  • Also, the agreement section of the informed consent will affirm that the opinions expressed by the participant are their own and do not reflect the view of any organization that they are employed by or associated with.

  • In addition, the Company has the sole and exclusive right and discretion to discontinue any of the Beverages under this Agreement, provided (i) such Beverage is discontinued on a national basis in Authorized Containers and in such other containers as may have been authorized for use by other Bottlers under their respective bottle contracts, and (ii) the Company does not discontinue all Beverages under this Agreement.

  • The Company appoints the Bottler as its sole and exclusive purchaser of the Concentrates and Syrups for the purpose of manufacture, packaging and distribution of the Beverages under the Trademarks in Authorized Containers for sale in the Territory.

  • Company appoints Bottler as an authorized purchaser of the Concentrates for the purpose of manufacture of the Authorized Covered Beverages in Authorized Containers at the Regional Manufacturing Facilities.

  • Oils and fats of non- biological origin are excluded from the survey.

  • Authorized Contact is a representative authorized by Customer to request service changes using procedure outlined herein.

  • Exterior container means a MIL-STD-129 defined container, bundle, or assembly that is sufficient by reason of material, design, and construction to protect unit packs and intermediate containers and their contents during shipment and storage. It can be a unit pack or a container with a combination of unit packs or intermediate containers. An exterior container may or may not be used as a shipping container.

  • Outer burial container means any container which is designed for placement in the ground around a casket or an urn including but not limited to containers commonly known as burial vaults, urn vaults, grave boxes, grave liners, and lawn crypts.

  • Containers means any ISO standard container(s) with a maximum height of 9’6” including any reefer and/or other special containers, provided they meet ISO standards.

  • Authorized Facilities means the public facilities authorized to be financed, in whole or in part, by the CFD.

  • Storage container means a device in which sealed sources or radiation machines are secured and stored.

  • Food-contact surface means those surfaces of equipment and utensils with which food normally comes in contact, and those surfaces from which food may drain, drip, or splash back onto surfaces normally in contact with food.

  • Plastic container means an individual, separate, rigid plastic bottle, can, jar or carton, except for a blister pack, that is originally used to contain a product that is the subject of a retail sale.

  • Disinfectant contact time or "T in CT calculations" means the time in minutes that it takes for water to move from the point of disinfectant application or the previous point of disinfectant residual measurement to a point before or at the point where residual disinfectant concentration (C) is measured. Where only one (1) C is measured, T is the time in minutes that it takes for water to move from the point of disinfectant application to a point before or at where C is measured. Where more than one (1) C is measured, T is:
