Arbitrator List definition

Arbitrator List. As defined in Section 1.9(c).
Arbitrator List has the meaning given such term in Section 9.9(c).

  • The parties shall each advise the AAA of the qualifications of the arbitrator they desire and based on the advice received by the AAA pursuant to the preceding subparagraph, the AAA shall provide the parties with a list of three candidates (the "Arbitrator List"), with each party entitled to strike one of those candidates.

  • The AAA shall appoint an arbitrator from among the candidates who have not been struck from the Arbitrator List; and if for some reason the arbitrator appointed by the AAA is unable or unwilling to serve, or resigns or is removed by the AAA as the result of a challenge, the AAA shall repeat this process until an arbitrator is appointed who will preside over the arbitration.

  • The arbitration shall be conducted by one (1) neutral arbitrator whom the parties will choose, via the "alternate strike" process set forth below, from an initial list the AAA provides of eleven (11) persons whom the AAA deems meet the criteria of being a practicing attorney with experience in the area of mergers and acquisitions of domestic oil and gas or oilfield services companies (the "Arbitrator List").

  • By 5:00 p.m. Houston, Texas time on the fifth (5) business day after receipt of the Arbitrator List from the AAA, the responding party shall strike one arbitrator by faxed letter or email to the claiming party in accordance with the notice provisions set forth in Section 11.3 hereof.

  • Arbitrator means the authority nominated by Chief General Manager (CGM) for arbitration.

  • Referee means a person who is designated as a referee under the friend of the court act.

  • Mediation means any process in which a mediator facilitates communication and negotiation between the parties to assist them in reaching a voluntary agreement regarding their dispute.

  • Expedited Appeal means if a Member appeals a decision regarding a denied request for Prior Authorization (Pre-Service Claim) for an Urgent Care Claim, the Member or Member’s Authorized Representative can request an Expedited Appeal, either orally or in writing. Decisions regarding an Expedited Appeal are generally made within seventy-two (72) hours from the Plan’s receipt of the request.

  • JAMS means JAMS, Inc. or its successor entity, a judicial arbitration and mediation service.

  • Arbiter has the meaning set forth in Section 2.3(c).

  • Neutral ’ means an individual who, with respect to an issue in controversy, functions specifically to aid the parties in resolving the controversy;

  • ICC Rules means the Rules of Arbitration of the International Chamber of Commerce in effect on the date the applicable arbitration proceeding begins.

  • Appeal Tribunal means the all-citizen Tribunal duly appointed by Council to conduct hearings under this By-law; (200-08)

  • Accounting Arbitrator has the meaning set forth in Section 2.6(c).

  • Arbitral Tribunal means a sole arbitrator or a panel of arbitrators;

  • Arbitrable Dispute means any dispute arising under or in connection with this Agreement.

  • Arbitration Notice has the meaning set forth in Section 9.13.

  • AAA Rules has the meaning set forth in Section 11.2.
