The Class Action Waiver will be severable in any case in which the Rules Dispute or Arbitration Dispute is filed or pursued as an individual action and severance is necessary to ensure that the individual action proceeds in arbitration.
All matters relating to the arbitration, including any final award, will be considered the confidential information of the parties to the Arbitration Dispute.
