Applicable Facilities definition

Applicable Facilities means the Facilities of a Participating Company other than its De Minimis Facilities, producing its Applicable Products.

Applicable Facilities means the Facilities designated as such in the relevant Financial Assistance Facility Agreement.

Applicable Facilities has the meaning, with respect to each Development Company, provided in the CMA to which such Development Company is a party.

Examples of Applicable Facilities in a sentence

• The Executive Director of the Association shall have the authority to modify the inspection list proposed by the Company based upon the risk factors set forth below; however, to the extent the list proposed by the Company appropriately reflects the risk factors set forth below, there shall be a general presumption in favor of the Participating Companys suggested list of Applicable Facilities.

• The Beneficiary may, but is not obliged to, disburse such fees or expenses, if fund are available under the relevant Applicable Facilities Agreement, the Intercreditor Agreement and other related documents, which as of such moment from that moment shall be regarded as Secured Obligations for the purposes of this Amendment Agreement, and shall accrue interest from the time of payment under the terms set forth in the corresponding Applicable Facilities Agreement.

• In the list of Facilities that the Participating Company shall provide to the Association as part of its Monitoring Plan, the Company shall suggest specific Applicable Facilities that should be given priority for inspections conducted by accredited independent external monitors, taking into account the risk factors set forth below.

• Following the Initial Implementation Period, independent external monitors accredited by the Association shall continue independent external monitoring annually of the Applicable Facilities of each Participating Company.

• The report also shall include the information described in subparts (iv) through (x) below and shall describe the remedial actions taken by the Company in response to any significant and/or persistent patterns of noncompliance, or instances of serious noncompliance, with the Workplace Code or Monitoring Principles found by either internal or accredited independent external monitors at Applicable Facilities.

More Definitions of Applicable Facilities

Applicable Facilities means the collective reference to the revolving credit facility established pursuant to Section 2.01, each Incremental Term Loan and each separate loan facility established as Permitted Pari Passu Indebtedness.
