Affiliated Contractor definition

Affiliated Contractor means and refer to each general contractor and contractor who, as of the time of sale of the portion of the Property that is the subject of a Dispute: (i) is in the business of building, developing or constructing the Property for public purchase; and (ii) is a partner, member of, subsidiary of, or otherwise similarly affiliated with Declarant.
Affiliated Contractor or "Affiliate" means any company holding directly or indirectly a majority of shares in any company which is controlled directly or indirectly by any such aforesaid company. For the purpose of the foregoing definition:
Affiliated Contractor means any business entity that serves as a contractor or subcontractor to SD on any of SD’s Federal Contracts, or as a prime contractor for Federal Contractors under which SD serves as a subcontractor.

  • Approved Contractor means an “Approved Contractor” specified in the Key Details.

  • Subcontractors means subcontractors or subconsultants at any tier that are under the direct or indirect control or responsibility of the Contractor, and includes all independent contractors, agents, employees, authorized resellers, or anyone else for whom the Contractor may be liable at any tier, including a person or entity that is, or will be, providing or performing an essential aspect of this Contract, including Contractor’s manufacturers, distributors, and suppliers.

  • First-tier Subcontractor means any Subcontractor that has a contract with the General Contractor.

  • Affiliate of any specified Person means any other Person directly or indirectly controlling or controlled by or under direct or indirect common control with such specified Person. For the purposes of this definition, “control” when used with respect to any specified Person means the power to direct the management and policies of such Person, directly or indirectly, whether through the ownership of voting securities, by contract or otherwise; and the terms “controlling” and “controlled” have meanings correlative to the foregoing.
