If, and to the extent that, a breach of this contract has been caused by a Relevant Force Majeure Event, the Non-affected Party shall not be entitled to a Performance Order except to secure performance by the Affected Party of its obligations under this Clause 17.
Without prejudice to Clause 17.3, an Affected Party is only entitled to claim force majeure relief under this Clause 17 if it complies with the obligations to give Force Majeure Notices, Force Majeure Reports and provide other information under Clause 17.5 and to perform its obligations under Clause 17.6.
The corresponding obligations of the other Party will be suspended, and its time for performance of such obligations extended, to the same extent as those of the Affected Party.
If the Affected Party is prevented from performing the Affected Obligations by a Force Majeure Event for a continuous period of 3 months, either party may terminate this agreement by 30 days written notice to the other party.
If the Contractor is the Affected Party, it shall not be entitled to claim relief under this clause 16 to the extent that consequences of the relevant Force Majeure Event: are capable of being mitigated by the Contractor but the Contractor has failed to do so; and/or should have been foreseen and prevented or avoided by a prudent provider of services similar to the Services, operating to the standards required by this Agreement.
