Affected Clearing Member definition

Affected Clearing Member means a CM Affected Clearing Member or a BCM Affected Clearing Member, as the context requires.
Affected Clearing Member means each of the following: (i)a CM Affected Clearing Member and (ii)or a BCM Affected Clearing Member, as the context requires.

  • Should the amount of any such taxes or charges exceed the amount of the relevant Difference Claim, Eurex Clearing AG shall be entitled to discharge its payment obligation with respect to the Difference Claim by making payment of the relevant amount of the Difference Claim to the Affected Clearing Member for the account of the relevant ICM Client.

  • If no such act has been taken within one month after the Termination Date, Eurex Clearing AG shall be entitled to discharge the Difference Claim owed by it by payment to the Affected Clearing Member for the account of the ICM Client.

  • Upon the occurrence of a Termination Date (as defined in Number 7.2), all Clearing Licenses of the Affected Clearing Member (as defined in Number 6.2) shall expire automatically.

  • Upon the occurrence of a Clearing Member Termination Date, all Clearing Licenses of the Affected Clearing Member shall expire automatically.

  • The BCM Affected Clearing Member and the Non-Affected Clearing Members shall, subject to the Liability Cap, be obliged to make such Further Contributions to the Default Fund, in each case as soon as possible but no later than one Business Day following receipt of Eurex Clearing AG’s demand.

  • If an Affected Clearing Member is a Defaulter, this paragraph 12.4 shall not restrict the rights of the Clearing House to close out, terminate or liquidate any Contract in any other manner in accordance with Part 9 of the Rules.

  • Clearing Member means a registered broker-dealer which is a clearing member under the rules of O.C.C. and a member of a national securities exchange qualified to act as a custodian for an investment company, or any broker-dealer reasonably believed by the Custodian to be such a clearing member.

  • Recognised Clearing System means any clearing system listed in Section 246A of the Taxes Act (including, but not limited to, Euroclear, Clearstream Banking AG, Clearstream Banking SA and CREST) or any other system for clearing shares which is designated for the purposes of Chapter 1A in Part 27 of the Taxes Act, by the Irish Revenue Commissioners, as a recognised clearing system.

  • Affected Class has the meaning specified in Section 2.24(a).

  • Relevant Clearing System means (i) Euroclear, (ii) Clearstream, Luxembourg, or (iii) any other recognised clearing system in which ETP Securities of a Series may be cleared.

  • Clearing Participant means a person admitted as a participant under the Clearing Rules.

  • Exchanging Member means a Member that Exchanges some or all of its Units.

  • Trading Member means a Person who has been approved by Nadex to trade directly and not through a FCM Member on the Market, and does not include any FCM Member.

  • Clearing Agent means Clearstream Banking AG, Euroclear Bank S.A., and Clearstream Banking S.A. and such further or alternative clearing agent(s) or clearance system(s) as may be approved by the Issuer from time to time and notified to the Holders in accordance with General Condition 4 (each a “Clearing Agent” and together the “Clearing Agents”);

  • Clearing Firm means an entity that meets the requirements of clearing membership at a Clearing House that clears Trades in any or all of the MarketAxess SEF Swaps and is authorized to submit Trades for clearing to the Clearing House.

  • Foreign Clearing Agency means Clearstream and the Euroclear Operator.

  • Global warming potential means how much a given mass of a chemical contributes to global warming over a given time period compared to the same mass of carbon dioxide. Carbon dioxide's global warming potential is defined as 1.0.

  • Transfer Restricted Global Notes means Global Notes that bear or are required to bear or are subject to the Restricted Notes Legend.

  • Clearing Bank means the Bank or any other banking institution with whom a Payment Account has been established pursuant to a Blocked Account Agreement.

  • Affected Claim means any Claim other than an Unaffected Claim;

  • Restricted Global Security As defined in Section 3.01(c).

  • Controlling ownership interest means ownership of or entitlement to more than twenty-five percent of shares or capital or profits of the company;

  • European Clearing Systems means, collectively, Clearstream, Luxembourg and Euroclear.

  • Clearing System means Monte Titoli S.p.A., with offices in Piazza degli Affari no. 6, Milan, Italy ("Monte Titoli").

  • recognised clearing house means an organisation recognised as such pursuant to FSMA;

  • Non-Lead Securitization Determination Date means the “determination date” (or any term substantially similar thereto) as defined in the related Non-Lead Securitization Servicing Agreement.

  • Restricted Global Notes means 144A Global Notes and Regulation S Global Notes.

  • Clearing Corporation Security means securities which are in the custody of or maintained on the books of a Clearing Corporation or a nominee subject to the control of a Clearing Corporation and, if they are Certificated Securities in registered form, properly endorsed to or registered in the name of the Clearing Corporation or such nominee.

  • Protected class means a group of persons distinguished, or perceived to be distinguished, by race, color, religion, sex, sexual orientation, national origin, marital status, familial status, source of income or disability.

  • Clearing Account has the meaning set forth in Section 2.7.1 hereof.

  • Clearing Systems means Euroclear and Clearstream, Luxembourg;

  • Clearing Corporation The meaning specified in Section 8-102(a)(5) of the UCC.
