Third Party may create their own letterhead utilizing the MKM logo and statement. The MKM statement reads, “Proceeds from this event will benefit Melanoma Know More.” Third Party must state in the Third Party Event promotions and/or campaign the exact terms of the donation that will be given to MKM. For example, Third Party may state that 75% of profits, one-time donation of $1,000, or all proceeds will be donated to MKM. However, the promotion must not imply or state that MKM is the host of the Third Party Event. Any and all sponsors of the Third Party Event must be clearly identified. For example: “The Elks Club, Bob’s Variety, The Xxxxx Family, is hosting X event, with proceeds benefiting Melanoma Know More.” All promotions of the Third Party Event which mentions or includes the MKM name or logo must be approved by MKM in writing prior to printing or release. Third Party shall provide promotions for MKM approval five (5) business days before requested release date. Promotions may include, but not be limited to, newspaper articles, advertisements in print, flyers, email, social media postings, and any form of electronic communication. Third Party shall not suggest or imply that Third Party Event payments by participants qualify as charitable, tax-deductible contributions. MKM strictly forbids this type of language, whether verbal or written, since participating attendees receive something of value in return for their donation. Donations and Proceeds Protocol. Third Party must provide in writing the date by which MKM will receive the donation. However, Third Party shall provide the donation to MKM no later than thirty (30) days after the event. Third Party shall be solely responsible for the collection of all fees, entries, payments, and contributions for the Third Party Event. If checks are made payable to Melanoma Know More, Third Party must send the unendorsed checks along with the net proceeds of the Third Party Event directly to MKM. Third Party shall provide financial statements to MKM upon request in an efficient and reasonable manner.

ADVERTISEMENT AND PROMOTION. A. Operator shall not post or allow any signs or advertisements of any description to be painted or posted on the Park Property, any of the buildings or structures on the Park Property, and/or on any other property or improvement comprising part of Liberty State Park unless specifically approved by Department in writing. Operator shall not use the Department’s or State’s names, logos, images, or any data or results arising from the Agreement as part of any commercial advertising without first obtaining the written consent of the Department. Operator shall not be permitted to change or profit from the name of any structure or building on the Park Property by, for example, selling or licensing naming rights to the Park Property. Operator shall not change the name of any part of the Park Property without the prior written consent of the Department. Operator shall not issue news releases pertaining to any aspect of the services being provided under the Agreement without the prior written consent of Department.

Prior to the implementation of any and all promotion(s), photograph(s), video(s), and advertisement(s) of the License Operation and/or any scheduled event(s) at or pertaining to the License Operation, Licensee shall submit, and obtain Department’s written approval of, all such promotion(s), photograph(s), video(s), and advertisement(s). Licensee shall, in all promotion(s), photograph(s), video(s), and advertisement(s) of the License Operation and/or any scheduled event(s) at or pertaining to the License Operation, Licensee shall include on each website, including social media page(s) that the Area is administered by the State of New Jersey, Department of Environmental Protection, Division of Parks and Forestry, State Park Service.
ADVERTISEMENT AND PROMOTION. The College shall have the right to advertise and promote the Event subject to its discretion and consistent with College policy. The College shall have an unrestricted right to make and use photographs, films, video and/or audio recordings made of the Event by the College. Speaker shall refrain from advertising the Event without prior written approval of the College. Speaker shall not use the College's name or trademarks in connection with any advertising, marketing, or other promotional efforts or materials without the prior written approval of the College.
