Adverse Weather Conditions definition

Adverse Weather Conditions means any weather condition, i.e. cold temperature, rain, snow, strong winds, which may cause or result in street conditions requiring cleaning over and above normal accumulation of debris prior to acceptance of the Work by the City;
Adverse Weather Conditions means weather and sea conditions actually experienced at or near the Sabine Pass Facility that are sufficiently severe either: (a) to prevent an LNG Vessel from proceeding to berth, or unloading or departing from berth, in accordance with one or more of the following: (i) regulations published by a Governmental Authority; (ii) an Approval; or (iii) an order of a Pilot; or (b) to cause an actual determination by the master of an LNG Vessel that it is unsafe for such vessel to berth, unload or depart from berth.
Adverse Weather Conditions means weather and/or sea conditions actually experienced that are sufficiently severe to prevent an LNG Ship from proceeding to berth, unloading or departing from berth in accordance with the weather standards prescribed in published regulations in effect at the Discharge Port, or by order of the harbour master.

More Definitions of Adverse Weather Conditions

Adverse Weather Conditions means weather and/or sea conditions actually experienced that are, or are reasonably anticipated by the Port Authority and/or Harbour Master to become, sufficiently severe:
Adverse Weather Conditions means rainfall, lightning or wind at the Site (including the preparation for and effects thereof) which, as mutually agreed in writing by either Contractor’s Site Manager and Owner’s Site Manager or Contractor Representative and Owner Representative, reasonably prevents a significant majority of the planned Work at the Site from being safely executed, and which therefore requires Contractor to evacuate or stand down seventy percent (70%) (or more) of Contractor’s direct craft workforce for a Day.
Adverse Weather Conditions means weather, sea or metocean conditions actually experienced or forecasted which are sufficiently severe:
Adverse Weather Conditions weather or sea conditions actually experienced or reasonably forecasted at or near the Driftwood LNG Terminal that are sufficiently severe: (i) to prevent an LNG Tanker from proceeding to berth, or loading or departing from berth, in accordance with one or more of the following: (a) regulations published by a Governmental Authority; (b) an Approval; or (c) an order of a Pilot; or (ii) to cause an actual determination by the master of an LNG Tanker that it is unsafe for such LNG Tanker to berth, load, or depart from berth; Affiliate: with respect to any Person, any other Person that, directly or indirectly through one or more intermediaries controls, is controlled by or is under common control with such Person; for purposes of this definition, “control” (including, with correlative meanings, the terms “controlled by” and “under common control with”) means the direct or indirect ownership of fifty percent (50%) or more of the voting rights in a Person or the possession, directly or indirectly, of the power to direct or cause the direction of the management and policies of a Person, whether through the ownership of voting securities, by contract or otherwise; Agreement: this agreement, including the Exhibits hereto, as the same may be amended, modified or replaced from time to time;
Adverse Weather Conditions means weather and/or sea conditions forecast or experienced which exceed the weather and/or sea limits set out in any port operations manual (including the Operations Manual) applicable at the FSRU Terminal; and/or during which the master (a) moves or removes or disconnects from berth the Vessel for reasons of safety of the Vessel and/or the safety of those on board the Vessel or LNG Carrier; and/or (b) orders a full or partial cessation of operations on the Vessel.”
Adverse Weather Conditions means in excess of one (1) inch of rain per day as determined by an official National Weather Service measuring station in the area where the Project is located; snow; ice; sleet; high winds, or low temperatures, which based on nationally accepted standards prevent the completion of critical path items of the Work; or muddy site conditions that: (i) affect scheduled working hours on scheduled Work days; and (ii) directly, unavoidably and measurably affect a critical path activity of the Contractor; and (iii) cannot be mitigated through the reasonable efforts of the Contractor. The Contractor shall provide a weekly written report to Owner that identifies any Adverse Weather Conditions encountered during the preceding week, together with an explanation of any delays that the Contractor believes were a direct result of such Adverse Weather Conditions. Owner shall review the report and approve or disapprove the delays (which approval or disapproval shall not be unreasonably withheld or delayed). If the Contractor fails to provide Owner with such weekly reports, Owner may approve or disapprove a delay in its sole discretion. If Owner approves a delay in accordance with this Section then, to the extent affected directly, unavoidably and measurably, the Substantial Completion Date and Interim Completion Dates shall be extended for a period equal to the length of the approved delay.
Adverse Weather Conditions means weather and/or sea conditions actually experienced that are sufficiently severe to: (a) prevent a Vessel from proceeding to the Delivery Point, loading or unloading (as the case may be) and/or departing from the Delivery Point in accordance with the weather standards prescribed in published regulations in effect at the Discharge Location, or by the order of the relevant harbour master; and/or (b) cause an actual determination by the Master of the Vessel that it is unsafe for the Vessel to arrive at the Delivery Point, unload or depart from the Delivery Point.
