Adverse Order definition

Adverse Order means an order, judgment, injunction or other determination restricting payment by any Issuing Lender under or in accordance with a Letter or extending such Issuing Lender’s liability beyond the expiration date stated therein.
Adverse Order means an order of any court preventing Toy Biz from complying with this Agreement or consummating the Plan of Reorganization based wholly or in part on any contention that the board of directors of Toy Biz which approved this Agreement was not the duly authorized board of directors of Toy Biz at such time.
Adverse Order means, in connection with any proceeding related to Southern LNG, any order issued by the FERC that results in a modification to Southern LNG's revenue entitlement, cost of service, cost allocation, rate design, services, or billing determinants that adversely impacts Southern LNG's ability to recover its costs or return on equity, as such costs or return on equity existed prior to such proceeding, or if such proceeding relates to the True-Up Filing, as requested by Southern LNG in such True-Up Filing.

For purposes of this definition only: “Vertically Integrated Utility” means a utility that owns generation, includes such generation in a non-bypassable charge in its regulated rates, earns a regulated return on its investment in such generation, and that as of the date of its request for a Self Supply Exemption, has not divested more than seventy-five percent of its generation assets owned on May 20, 1996; and “Single Customer Entity” means an LSE that serves at retail only customers that are under common control with such LSE, where such control means holding 51% or more of the voting securities or voting interests of the LSE and all its retail customers.

  • Proposed Change Order (PCO means a document that informs Contractor of a proposed change in the Work and appropriately describes or otherwise documents such change including Contractor’s response of pricing for the proposed change.
