The determination of Actual Operating Costs and Estimated Operating Costs Allocable to the Premises shall be made by Landlord.
Landlord shall maintain records concerning Estimated and Actual Operating Costs for thirty-six (36) months following the period covered by the statement or statements furnished Tenant, after which Landlord may dispose of such records.
Notwithstanding the foregoing and so long as an Event of Default does not occur under this Lease, Tenant will only be required to pay one-half (1/2) of the Actual Operating Costs otherwise due and payable by Tenant during the first six (6) months of the Lease Term.
