Actual Operating Costs definition

Actual Operating Costs means: (a) the Franchisee's total operating expenses for the period being reviewed as stated in its profit and loss account, including any of the following operating expenses that are payable during that period: (i) amounts payable to the Secretary of State and Network Rail; (ii) taxation; (iii) shareholder distributions including dividends; (iv) interest; (v) capital expenditure (net of grants received); (vi) lease payments in relation to on- balance sheet leased assets; and
Actual Operating Costs means: (a) the Franchisee's total operating expenses for the period being reviewed as stated in its profit and loss account, including any of the following operating expenses that are payable during that period: (i) amounts payable to the Secretary of State and Network Rail; (ii) taxation; (iii) shareholder distributions including dividends; (iv) interest; (v) capital expenditure (net of grants received); and (vi) lease payments in relation to on-balance sheet leased assets, but excluding any of the following expenses that are payable in that period: (A) interest relating to on-balance sheet leased assets; (B) depreciation; (C) amortisation; and (D) bad debt provisions; and (b) either: (i) plus any reduction in the total amount owing by the Franchisee to creditors over that period; or (ii) less any increase in the total amount owing by the Franchisee to creditors over that period, where creditors: (A) include any persons owed amounts by the Franchisee in respect of loans or funding agreements, operating expenses, including the types of expenses set out in paragraphs (a)(i) to (v) inclusive, provisions and deferred income balances; but (B) exclude persons owed amounts by the Franchisee in respect of season ticket liabilities, lease liabilities in relation to on- balance sheet leased assets and liabilities in relation to grants received for the purchase of fixed assets;
Actual Operating Costs means the actual expenses paid or incurred by Landlord for Operating Costs during any Lease Year of the term hereof.

Examples of Actual Operating Costs in a sentence

  • The determination of Actual Operating Costs and Estimated Operating Costs Allocable to the Premises shall be made by Landlord.

  • Landlord shall maintain records concerning Estimated and Actual Operating Costs for thirty-six (36) months following the period covered by the statement or statements furnished Tenant, after which Landlord may dispose of such records.

  • Notwithstanding the foregoing and so long as an Event of Default does not occur under this Lease, Tenant will only be required to pay one-half (1/2) of the Actual Operating Costs otherwise due and payable by Tenant during the first six (6) months of the Lease Term.

More Definitions of Actual Operating Costs

Actual Operating Costs means, for any period, the amount of funds actually expended by a Person in respect of Operating Costs.
Actual Operating Costs means the actual Operating Costs for any Operating Year, adjusted as if ninety-five percent (95%) of the total rentable area of the Building had been occupied for the entire Operating Year.
Actual Operating Costs means, in relation to a Rig, the total of the costs and Taxes incurred by the Borrower, the Rig Owner which is the owner of that Rig and/or the Sponsor in relation to the operation and Earnings, respectively, of that Rig, including, but not limited to, the costs incurred in connection with the maintenance, insurance and repair of that Rig and the fulfilment by that Rig Owner of its obligations under the Bareboat Charter and clauses 7.1.1, 7.1.2, 7.1.5, 7.1.6, 7.2, 7.3.5, 7.3.6, 7.3.10, 7.3.14 (but only insofar as the indemnity obligations under clause 7.3.14 relate to the matters referred to therein which arise out of (i) any failure by the Sponsor to comply with any applicable law, regulation or order, or (ii) the relevant Rig becoming an obstruction to navigation prior to that Rig becoming a wreck) and 9 of the General Assignment, the Borrower of its obligations under the Bareboat Charter (other than the payment of Advance Bareboat Hire), clauses 7.1.1, 7.1.2, 7.1.5, 7.1.6, 7.2, 7.3.5, 7.3.6, 7.3.10, 7.3.14 and 9 of the General Assignment and the Charter and the Sponsor of its obligations under the Services Agreement and clauses 8.2.2, 8.2.7 and (save for clause 11.3.4) 11 of the Deed of Undertaking, in each case, relating to that Rig;
Actual Operating Costs means the cost required for transportation, warehouse operations, Product buying, and applicable administration specific to TFM.
Actual Operating Costs means the actual Operating Costs for any Operating Year, adjusted as if ninety-five percent (95%) of the total rentable area of the Building had been occupied for the entire Operating Year. Actual Operating Costs shall not include costs which are unusually high due to extraordinary circumstances such as embargoes, boycotts, unusual security expenditures, insurance surcharges or unusually high premiums or utility rate increases due to shorter term events or circumstances.
