Acknowledged Product definition

Acknowledged Product of Adopter means (i) with respect to a product model first shipped after the Certification Requirement Date, a Test Unit that is the subject of an Acknowledgement of Compliance Testing and any other Licensed Product of Adopter that is not materially different from such Test Unit with respect to the means by which such Licensed Product achieves compliance with the Test Criteria and Certification Questionnaire and (ii) and with respect to a product model first shipped prior to the Certification Requirement Date, a product model for which Adopter has not received a failure notice from the Authorized Certification Entity after the Certification Requirement Date.

Unless a product is considered a milk product under this subdivision, milk product does not include dietary products, infant formula, ice cream or other desserts, cheese, or butter. Milk products include the following:

  • Licensed Products means tangible materials which, in the course of manufacture, use, sale, or importation, would be within the scope of one or more claims of the Licensed Patent Rights that have not been held unpatentable, invalid or unenforceable by an unappealed or unappealable judgment of a court of competent jurisdiction.

  • Diagnostic Product means In Vitro Diagnostics, In Vivo Diagnostic Agents and any product used for Diagnosis.

  • Manufactured end product means any end product in product and service codes (PSCs) 1000-9999, except—

  • Competing Product means [***].

  • Licensed Field means all fields of use.

  • Other Product means Product which an End User acquired from sources other than Integrator.

  • Manufactured products means items and construction materials composed in whole or in part of non-ferrous metals such as aluminum; plastics and polymer-based products such as polyvinyl chloride pipe; aggregates such as concrete; glass, including optical fiber; and lumber.

  • Pharmaceutical Product shall have the meaning ascribed to such term in Section 3.1(hh).

  • Licensed Services means all functions performed by the Licensed System.

  • Replacement Product means electric generating capacity, capacity-related benefits, environmental attributes, Energy or other electric products from a generation resource other than the Facility that are provided or delivered to replace or substitute for Contract Capacity or Storage Capacity (or any Capacity-Related Benefit, Environmental Attribute, Other Electric Product, Contract Energy, or Storage Energy associated therewith), in each case, in whole or in part, pursuant to Section 4.6.

  • Licensed Fields of Use means the fields of use identified in Appendix B.

  • Licensed producer means a person or entity licensed to produce medical cannabis.

  • Biological product means a virus, therapeutic serum, toxin, antitoxin, vaccine, blood, blood component or derivative, allergenic product, protein other than a chemically synthesized polypeptide, or analogous product, or arsphenamine or any derivative of arsphenamine or any other trivalent organic arsenic compound, applicable to the prevention, treatment, or cure of a disease or condition of human beings.

  • Existing Product means any formulation of the same product category and form sold, supplied, manufactured, or offered for sale in California prior to the following dates, or any subsequently introduced identical formulation:
