To the extent that the AAA Procedures and this Agreement are in conflict, the terms of this Agreement shall control.
Any Dispute that is not resolved pursuant to Section 11.10(a) may be submitted for mediation before a single mediator in accordance with the provisions contained herein and in accordance with the Commercial Mediation Procedures of the AAA in effect at the time of the mediation (“AAA Procedures”); provided, however, that in the event of any conflict between the procedures herein and the AAA Procedures, the procedures herein shall control.
