This Amended and Restated Credit Agreement (the “Agreement”), dated as of May 10, 2016, as modified by that certain Modification Agreement dated as of September 27, 2017 and that certain Second Modification dated as of August 7, 2019, is among The New Home Company Inc., a Delaware corporation, as Borrower, the Lenders and U.S. Bank National Association d/b/a Housing Capital Company, a national banking association, as LC Issuer, Swing Line Lender and Administrative Agent.
