This SUPPLY AGREEMENT is made and entered into on this 17th day of January, 2013 (the “Closing Date”) and shall be effective retroactively as of January 1, 2013 (the “Effective Date”), by and among MICRON TECHNOLOGY, INC., a Delaware corporation (“Micron”), MICRON SEMICONDUCTOR ASIA PTE. LTD., a Singapore private limited company and wholly-owned Subsidiary (as defined hereinafter) of Micron (the “Purchaser”), and INOTERA MEMORIES, INC. (Inotera Memories, Inc. This 2015 SUPPLY AGREEMENT is made and entered into on this 10th day of February, 2015 (the “Agreement Date”) and shall be effective as of February 10, 2015 (the “Effective Date”), by and among MICRON TECHNOLOGY, INC., a Delaware corporation (“Micron”), MICRON SEMICONDUCTOR ASIA PTE.
