This Data Processing Agreement (“DPA”) amends and is incorporated into the terms of any existing and current agreement between Qubole, Inc., a Delaware corporation and its subsidiaries Qubole Software India Pvt. Ltd, a private limited company incorporated in India, and Qubole Ltd, a private limited company incorporated in England and Wales (collectively, “Qubole”) and the counterparty signing these terms (“Customer”), which, as a result, Qubole accesses, collects, acquires, receives, transfers, processes, and/or uses Personal Data (defined below) from or on behalf of Customer or its Affiliates (“Agreement”).
