THIS AGREEMENT is made and entered into this 3rd day of September, 2008, by and between the City of Naples, Florida, a municipal corporation, (hereinafter referred to as the " OWNER") and M actec Engineering and Consulting, Inc. a Florida Corporation, authorized to do business in the State of Florida, whose business address is 3627 Progress Avenue, Naples, FL 34104 (hereinafter referred to as the " CONSULTANT" ).
