This item is before the city council based upon a request made by Rio Tinto AUM (“Rio Tinto”) to install, maintain, operate and, upon termination, to remove certain groundwater monitoring wells along, upon and under certain City right-of-way and property as set forth in the drawing on the aerial photograph on the following page. Rio Tinto is specifically required by the United States Environmental Protection Agency (the “EPA”) to install groundwater monitoring wells at the intended locations shown on the aerial photograph below. In order to accomplish this work, Rio Tinto seeks to enter into a license agreement with the City to enter upon City property and right-of-way.

Helzberg’s Diamond Shops, Inc. (“Helzberg’s”) has a serious need to install a total of eight (8) groundwater depression wells (de-watering wells), pumps and related facilities (collectively, the “Facilities”) immediately adjacent to its office building having a street address of 1825 Swift in North Kansas City, Missouri (the “City”). The lower level of Helzberg’s building is subject to flooding, which has occurred in the past due to hydrostatic pressure1 against the foundation when the Missouri River stage level is higher than thirty-four feet. The purpose of installing the Facilities is to remove groundwater around the building thereby preventing groundwater from entering the building and causing damage to the building and its contents.
