YOUR EXCLUSIVE REMEDY. If, during the sixty (60) day warranty period, the Software fails to comply with the limited warranty set forth above, provided you notify Snap-on within such sixty (60) day warranty period, Snap-on shall, at Snap- on's sole option, either: (i) the return the price paid (if any) for the Software; or (ii) repair or replace at no charge, the Software not meeting the Limited Warranty, and which is returned to Snap-on at your expense with a copy of the sales receipt. YOUR EXCLUSIVE REMEDY. 8.1 Except for any refund elected by NCG, you are not entitled to any damages including but not limited to incidental or consequential damages, special or indirect (such as loss of profit, loss of data, loss of goodwill), arising out of or in any way related to the use of or inability to use the Software, the provisions of or failure to provide Support, malfunction due to implementation of any Solution or otherwise under or in connection with any provision of the Agreement.
YOUR EXCLUSIVE REMEDY. If only one of our products is actually used in this project and that product is proven defective, you will receive, as your sole remedy, MAPEI replacement product for only that specific portion of the original installation requiring replacement. Maximum value of this Warranty will be forty thousand dollars ($40,000). The value of the warranty is to be split between service and product at a 50/50 ratio.
