Your Agreement with Us. You've requested that we set up an Account for you. When you access your Account for the first time, it confirms that you accept the terms of this Agreement and that you request renewal and replacement Cards. This Agreement sets out the terms under which you may use your Account, Card and PIN. You confirm that you've requested this Agreement, and all communications and documents from us, to be in English until you advise us otherwise. It’s made up of these Pay as you go Terms and Charges, the pricing guide for your bundle, the conditions of any optional extras you may choose to add (e.g. Vodafone Big Value Bundles), the General Network Terms and our Acceptable Use Policy. These terms cover the SIM card and any services you use but do not cover any equipment (e.g. the purchase of your phone). Our Agreement This “CIT Bank Agreement for Personal Accounts” document is designed for use with CIT Bank’s companion disclosures, fee schedules and any applicable product or service addenda (together referred to as the “Agreement”). This Agreement explains CIT Bank’s consumer deposit accounts and other related services (the “Services”) we make available to you, as well as the terms and fees that govern these accounts and services. When you open an account on our website you enroll in our Online Banking Services and agree and consent to all terms and conditions of this Agreement which includes your authorization for us to accept your electronic instructions to perform specific functions initiated by you on our Online Banking website. This Agreement is provided to you and accepted by you electronically pursuant to the E-Sign Disclosure and Consent you agreed to when you began the enrollment process for Online Banking. We recommend that you print this Agreement for your records, or you may obtain a paper copy of this Agreement at no charge by calling our Contact Center at 855-462- 2652 or writing to CIT Bank, P.O. Box 7056, Pasadena, CA 91109-9699. We may add to, delete or change the terms of this Agreement at any time subject to applicable law. Except as indicated herein, we will inform you of changes that affect your rights and obligations. Throughout this Agreement, the words “you,” “your” and “yours” refer to the account owner or owners. Each person listed on our account records is an owner of the account opened under this Agreement. “We,” “us,” “the Bank” and “our” refer to CIT Bank. This Agreement contains important information about your accounts and the Services. You are responsible for ensuring that all authorized signers on your account are familiar with our Agreement. We recommend you retain a copy of this Agreement (and any other notices the Bank provides you regarding changes to this Agreement) for as long as you maintain an account with us. This Agreement does not apply to any accounts you may have with First-Citizens Bank & Trust Company, including accounts opened at First Citizen Bank branches, except as noted otherwise herein.

You understand the terms of this Account Agreement Using your Account means that you understand, accept and agree to the terms contained in this Account Agreement, and you understand we may change it at any time. Using your Account also means that you understand and agree to the terms of the loyalty program applicable to your Account. The terms of your loyalty program are contained in a separate agreement. Your Agreement with Us. If you have a Market Retail Contract with us, you have given us your consent to supply Energy to your Supply Address. Your Market Retail Contract consists of your Terms, and your Energy Plan which summarises the key prices and other costs associated with your Agreement. Your Market Retail Contract commences on the date that you accept our offer and is subject to any cooling off rights that you may have. We may not commence supplying Energy to you until the Supply Start Date as set out in the Terms. Our Standard Retail Contract may automatically apply to you if you have not accepted a Market Retail Contract from us. This may occur where you have moved into premises that is already supplied by us or where your previous market retail contract came to an end and you did not enter into another market retail contract with us (or another retailer). You will be deemed to be taking Energy under our Standard Retail Contract based onTango Energy’s published standing offer rates if you take Energy at a Supply Address for which we are the responsible energy retailer without having entered into a Energy contract with us or another retailer.
