Xxxxxx Xxxxxx and Xx. Xxxxxxx Xxxxx for the Plaintiff Xx. Xxxxxx Xxxxxxx Xxxxxxxxx for the Defendant Hearing Date: 09 November 2016 CATCHWORDS: Practice and ProcedureEx parte Injunction granted – Inter partes hearing of application to continue the injunction based on Undertaking – Was there an undertaking - Final Judgment – Is Undertaking still subsisting – Is there an extant cause of action - interlocutory relief is merely ancillary and incidental to a pre- existing cause of action. The Plaintiff Pension Fund applied to the Supreme Court for an injunction to restrain the Defendant Union, its servants and/or agents from interfering with the operation of the Plaintiff. The application was made in an action filed in 2014 in which the sole relief that was claimed was an injunction in similar terms pending the conclusion of another action that was filed in 2012 between the Plaintiff and several of its former Trustees. The 2012 action came to an end shortly after the commencement of the 2014 action, with a Final monetary Judgment being entered by consent by the Plaintiff against the former trustees. At the time of the application the Plaintiff claimed that it was currently in the process of enforcing the Judgment, and that the trustees had applied to have it set aside. In its application, the Plaintiff claimed that it had restrained itself from approaching the court sooner because of an undertaking given by Counsel for the Defendant in the 2014 action, which their Attorney had relied upon. They alleged that the Defendant was now in the process of dishonouring the undertaking. The Defendant queried whether an undertaking had in fact been given and also queried whether the Plaintiff had met the requisite criteria for the issuance of an injunction.

Xxxxxx Xxxxxx and Xx. Xxxx Xxxx. The agreements between the two institutions allow students from FPCC who are majoring in Pre- Engineering to seamlessly transfer to the college of engineering at MSU. The FPCC Pre-Engineering degree program is funded by the TCUP grant, a $2.5 million grant funded by the National Science Foundation (NSF). The FPCC Associate of Science Degree (AS) in Pre-Engineering is designed to prepare students to transfer to a four-year institution to complete their Bachelor of Science (B.S.) degree in engineering. The Pre-Engineering program provides students with a strong foundation in mathematics, physics, chemistry, and introductory engineering courses that enable them to successfully complete their engineering degree. Students in the Pre-Engineering degree program can complete the first two years of their engineering degree program at FPCC then transfer to any university of their choice to complete their engineering degree. Students interested in studying engineering must have a strong background in mathematics. Calculus I (Calculus for Engineering) is the first math course that counts towards an engineering degree program. However, students can start at lower-level math courses and build up their Math skills towards calculus. The benefits for students who start their engineering degree program at FPCC are huge. FPCC is accredited by the Northwest Commission of Colleges and Universities (NWCCU). All the courses taken at FPCC are transferable to any engineering program. FPCC has Quality STEM (Science, Technology, Engineering and Math) faculty: 4 PhD’s and 2 MS’s. Students can save over $32000 in the first two years of their engineering program compared to starting at MSU, Bozeman. The savings are even greater if a student attends an out-of-state institution. The TCUP grant provides students in the Pre-Engineering program with stipends of $800 each per semester and student employment such as tutoring and research at $12/hour.
