Xxxx Payments. The Operator shall timely pay all bills related to the System which are proper, appropriate and not otherwise disputed and which it has authority to pay and shall assure that, to the extent within the Operator’s control, no mechanics’ or similar Encumbrances are filed against any portion of the System. In the event that the Operator fails to timely pay any such xxxx and such failure is not due to a District Fault, the District shall have the right, but not the obligation, to pay such xxxx and to seek reimbursement from the Operator.
