Xxxx Payment Service. As part of the Dalhart Federal Savings Online Banking, you can schedule payment of your periodic bills. You can arrange for the payment of current, future and recurring bills from your Dalhart Federal Savings & Loan Association, SSB "checking account". There is no limit to the number of payments that may be authorized. You may pay any merchant or individual approved by Dalhart Federal Savings & Loan Association, SSB. By furnishing us with the names of your payees/merchants and their addresses, you authorize us to follow the payment instructions to these payees/merchants that you provide through Online Banking. When we receive a payment instruction (for current or future date), we will remit funds to the payee on your behalf, from your designated checking account, on the day you have instructed the payment to be sent (Payment Date). However, we shall not be obligated to make any such payment unless your account and/or overdraft protection plan has sufficient funds or credit availability to pay the xxxx on the Payment Date. Funds for ALL xxxx payments made by check will be withdrawn from your account on the DAY the check item clears your account. NOTE: Any payments made through Xxxx Payment require sufficient time for your payee to credit your account properly. To avoid incurring a finance charge or other charge, you must schedule a payment far enough in advance of the due date of your payment. Dalhart Federal Savings & Loan Association SSB shall not be responsible for any charges imposed or any other action taken by a payee resulting from a payment that you have not scheduled properly, including any applicable finance charges and late fees. In addition, Dalhart Federal Savings & Loan Association SSB will not be liable if any third party through whom any xxxx payment is made fails to properly transmit the payment to the intended payee. Dalhart Federal Savings & Loan Association SSB will not be liable for delays or losses of payments caused by the U.S. Postal Service or other delivery service. We will also not be liable if there are insufficient funds or credit availability in your designated payment account and/or overdraft protection plan; if a legal order directs us to prohibit withdrawals from the payment account; if the payment account is closed or frozen; or if any part of the electronic funds transfer system is not working properly. Dalhart Federal Savings & Loan Association, SSB will not be liable for xxxx payments not completed due to circumstances beyond our control (such as fire, telecommunication outages, strikes, or natural disasters). Dalhart Federal Savings & Loan Association SSB will not be liable for indirect, special, or consequential damages arising out of the use of Xxxx Payment. Dalhart Federal Savings & Loan Association, SSB will not be liable if a payee will not accept payments made through Xxxx Payment. Dalhart Federal Savings & Loan Association, SSB reserves the right to terminate your use of Xxxx Payment at any time without prior notice. There will be no monthly Xxxx Xxxxx fees assessed; however there may be fees that may be assessed due to special requests made by you. This includes requests for photocopies of checks ($2.00 per check), and $12 for each stop payment. A $25 non-sufficient funds (NSF) fee will be assessed if the Xxxx Payment system attempts to pay a xxxx but cannot due to insufficient funds in the account and the item is returned unpaid. The $25 NSF fee will be assessed each time an attempt is made to pay the xxxx. A $25 non-sufficient funds (NSF) fee will be assessed if the Xxxx Payment system pays a xxxx and the account has insufficient funds when the items clear the account. If the payment account has insufficient funds to cover the fees, the Bank may deduct the fee from any other transaction account linked to Online Banking. If the fee cannot be paid, we may cancel your Xxxx Payment service.

If the Merchant is not set up for electronic payments, the service will generate a paper check for payment. Payment Dates should be prior to any late payment date or grace period. When you have scheduled a payment, you authorize Advia Credit Union to debit your Payment Account and remit funds on your behalf. You certify that your Payment Account is an account from which you are authorized to make payments and any payment you make will be debited from this account. You also authorize us to credit the Payment Account on account of any returned payments from using Xxxx Pay. Xxxx Pay will incur no liability and any service guarantee shall be void if Xxxx Pay is unable to complete any payments initiated because of any of the following: • You have not be responsible provided Xxxx Pay with the correct payment account information, or the correct name, address, phone number, or account information for the Merchant upon initiation of the payment; and/or, • Circumstances beyond the control of Xxxx Pay (such as, but not limited to, fire, flood, or interference from an outside force) prevent the proper execution of the transaction and Xxxx Pay has taken reasonable precautions to avoid those circumstances; • The payment-processing center is not working properly and you know or have been advised by Xxxx Pay about the malfunction before you execute the transaction; You agree to have available and collected funds on deposit in the designated Payment Account in amounts sufficient to pay for all xxxx payments requested, as well as, any charges imposed other payment obligations you have to Advia Credit Union. Advia Credit Union reserves the right, without liability, to reject or reverse a xxxx payment if you fail to comply with this requirement or any other action taken by terms of this Agreement. Dalhart Federal Savings & Loan Association SSB We will send you a message only once, and only with your explicit agreement as indicated by your continuation of the process flow. We will not be liable for any delays or losses failures in your receipt of payments caused any SMS messages as delivery is subject to effective transmission from your network operator and processing by your mobile device. SMS message services are provided on an AS IS, AS AVAILABLE basis. Data obtained from you in connection with the U.S. Postal Service or SMS service may include your mobile phone number, your carrier's name, and the date, time, and content of your messages and other delivery serviceinformation that you may provide. We may use this information to contact you and to provide the services you request from us, and to otherwise operate, develop, and improve the Services. Your wireless carrier and other service providers may also collect data from your SMS usage, and their practices are governed by their own policies. We will only use the information you provide to the Services to transmit your text message or as otherwise described in this Agreement. Nonetheless, we reserve the right at all times to disclose any information as necessary to satisfy any law, regulation, or governmental request, to avoid liability, or to protect our rights or property. When you complete forms online or otherwise provide us information in connection with the Services, you agree to provide accurate, complete, and true information. The Services will use its best efforts to research and correct the returned payment, or void the payment account and/or overdraft protection plan; if and credit your Payment Account.
