Xxxx Payment Service. The Xxxx Payment service or "Xxxx Pay" is an optional electronic payment system that permits you to initiate and authorize payments from your account(s) to payees, which you have selected in advance, to receive payments by means of this service (a "payee" is a person, organization, or business you are paying). To participate in Xxxx Pay, you must: be a customer in good standing, have an account with Gold Coast Bank, and have access to our Online Banking service. The Xxxx Pay service can be accessed only via Online Banking and is a separate service made available to you after your enrollment online and Financial Institution approval of that enrollment. Participation in Xxxx Pay is voluntary and may incur service charges per Schedule A as amended. In participation of Xxxx Pay and in providing the Service with names and account information of Billers to whom you wish to direct payments, you authorize us to follow the Payment Instructions received through the Service. In order to process payments more efficiently and effectively, our Service Provider may edit or alter payment data or data formats in accordance with Xxxxxx directives. When the Service receives a Payment Instruction, you authorize our Xxxx Payment Service Provider to debit your Payment Account and remit funds on your behalf so that the funds arrive as close as reasonably possible to the Scheduled Payment Date designated by you. You also authorize our Service Provider to credit your Payment Account for payments returned to the Service by the United States Postal Service or Xxxxxx, or payments remitted to you on behalf of another authorized user of the service. Our Xxxx Payment Service Provider reserves the right to select the method in which funds are remitted on your behalf to the Xxxxxx. These payment methods may include, but may not be limited to, an electronic payment or an electronic to check payment. You may cancel or edit any Scheduled Payment (if processing has not begun) by following the directions within the Service. There is no charge for canceling or editing a Scheduled Payment. However, once the Service has begun processing a Scheduled Payment, it cannot be cancelled or edited; therefore, a stop payment request must be submitted, as described within this Agreement. The ability of this Financial Institution and its Service Provider to process a stop payment on a Xxxx Payment request will depend on the payment method and whether or not a check has cleared. We may also not have a reasonable opportunity to act on any stop payment request after a payment has been processed. For Xxxx Pay stop payment requests, contact the Financial Institution at (312) 587‐3200 or visit the Financial Institution in person. Although we will make every effort to accommodate your request, we will have no liability for failing to do so. We may also require you to present your stop payment request in writing within 14 days. The charge for each stop payment request will be the current charge for such service as set forth in the bank’s fee schedule. Payments to Billers outside of the United States or its territories are prohibited through the Service. Tax payments and court ordered payments may be scheduled at your own risk. In no event shall this Financial Institution or its Service Provider(s) be liable for any claims or damages resulting from the scheduling of these types of payments. We reserve the right to refuse to pay any Xxxxxx to whom you may direct a payment. You will be promptly notified if we decide to refuse payment to a Xxxxxx; however, notification is not required if you attempt to make a prohibited payment or an exception payment as outlined under this Agreement. If we are unable to complete your Xxxx Pay transaction for any reason (for example, there are insufficient funds in your Payment Account to cover the transaction), the transaction will not be completed.

The Xxxx Pay service can be accessed only via Online Banking and is a separate service made available to you after your enrollment online and Financial Institution approval of that enrollment. Participation in Xxxx Pay is voluntary and may incur service charges per Schedule A as amended. Gateway Bank FSB shall not be responsible for payments returned any charges imposed or any other action taken by a payee resulting from a payment that you have not scheduled properly, including any applicable finance charges and late fees. In addition, Gateway Bank FSB will not be liable if any third party through whom any xxxx payment is made fails to properly transmit the payment to the Service intended payee. Gateway Bank FSB will not be liable for delays or losses of payments caused by the United States U.S. Postal Service or Xxxxxxother delivery service. We will also not be liable if there are insufficient funds or credit availability in your designated payment account and/or overdraft protection plan; if a legal order directs us to prohibit withdrawals from the payment account; if the payment account is closed or frozen; or if any part of the electronic funds transfer system is not working properly. Gateway Bank FSB will not be liable for xxxx payments not completed due to circumstances beyond our control (such as fire, telecommunication outages, strikes, or payments remitted to you on behalf of another authorized user natural disasters). Gateway Bank FSB will not be liable for indirect, special, or consequential damages arising out of the serviceuse of Xxxx Payment. Our Gateway Bank FSB will not be liable if a payee will not accept payments made through Xxxx Payment Service Provider Payment. Gateway Bank FSB reserves the right to select terminate your use of Xxxx Payment at any time without prior notice. Xxxx Payment Fees: Gateway Bank F.S.B. does not charge a fee for your use of the method in which funds are remitted on your behalf to the Xxxxxx. Xxxx Payment Service. The Xxxx Payment service or "Service is provided by Xxxx Pay" is an optional electronic payment system that Xxxxx & Associates (“XXX”). The Xxxx Payment Service permits you to initiate and authorize use your Internet-enable device to direct payments from your account(sdesignated online Xxxx Pay Account to third parties you wish to pay. Your Xxxx Pay Account must be a checking account. You may designate multiple Xxxx Pay Accounts. Through the Xxxx Payment Service, you can pay bills from your Xxxx Pay Account to businesses or individuals. While Catskill Xxxxxx Bank coordinates the Xxxx Payment Service with XXX, XXX performs all functions in connection with the Xxxx Payment Service. By using the Xxxx Payment Service, you acknowledge and agree that XXX is solely responsible for administration of the Xxxx Payment Service and waive all claims against the Bank arising out of your use of such Service. All payments you make will be deducted from the Account that you designated for that payment. Any payments you wish to make through this Service must be payable in U.S. dollars to a payee located in the continental United States. XXX reserves the right to restrict types of payees to whom payments may be made using the Service from time to time. You should not use the Xxxx Payment Service to make payments to settle securities purchases, payments to interest bearing accounts, tax payments, or court ordered payments. Payments for these payees will be your sole responsibility if delayed or improperly processed or credited. Funds must be available in your Xxxx Pay Account on the scheduled payment date. If the date you schedule a payment to be initiated falls on a non-business day (Saturday, Sunday or holiday), funds must be available in your Xxxx Pay Account the previous business day (e.g., Friday). Funds are withdrawn from your Xxxx Pay Account immediately when the payment is sent electronically. Payments sent by check will be deducted from your Account when the check is presented for payment by the payee. You may choose to schedule payments to recur in the same amount at regular weekly, bi-weekly, monthly, semi-monthly, quarterly, annual or semi-annual intervals (a “recurring payment”). If a recurring payment is chosen, the xxxx will be paid automatically each billing period. If the payment is not a recurring payment, it will be a “one-time payment”. One-time payments are not made until you enter the amount of the current xxxx and the date of payment. You may also change or skip payments that are recurring payments. However, you must allow at least three (3) business days after we receive any change to information you have given us about a payee for XXX to reflect the change in its records. When you create a new payee in the Xxxx Payment Service, it has a temporary status until XXX has had sufficient time to set up the account, and, for your business payees, which to verify information about your Account. You should schedule a payment to a new payee at least ten (10) business days before any payment due date, to allow XXX time to set up the payee and verify information about your Account with the payee. For all subsequent payments, you should allow for a reasonable time period, generally at least 3 to 4 business days for electronic payments and 5-7 business days for check payments between the date you schedule a payment to be initiated and the payment due date (that is, the due date shown on your invoice or provided in your agreement with the payee, not taking into account any applicable grace period). If you do not, you will be fully responsible for all late fees, finance charges or other action taken by the payee. Catskill Xxxxxx Bank does not have any duty to monitor the payments that are made through the Xxxx Payment Service. XXX and Catskill Xxxxxx Bank are only responsible for exercising ordinary care in processing and sending payments upon your authorization in accordance with this Agreement. XXX and Catskill Xxxxxx Bank will not be liable in any way for damages you incur if you do not have sufficient funds in your Xxxx Pay Account to make the payment on the processing date, for delays in mail delivery, for changes to the payee’s address or account number unless you have selected advised us of the change sufficiently in advance, for the failure of any payee to receive payments by means of this service (correctly account for or credit the payment in a "payee" is a person, organizationtimely manner, or for any other circumstances beyond the reasonable control of XXX or Catskill Xxxxxx Bank. Xxxx Payment Service. This service is available for all Accounts except Time Deposit Accounts. The Xxxx Payment Customer may request this service by checking the appropriate box in the Account Application at the time an Account is established or "Xxxx Pay" by making a specific written request at any time thereafter.
