Revised October 2017. xxxxx://xxx.xxx.xxx/policies-post/wma-statement-on-organ-and-tissue- donation/ Agreement Development and participants The concept of the GBF was first discussed with delegates attending the Second World Eye Bank Symposium in San Diego 2015, and subsequently agreed to by the Global Alliance of Eye Bank Associations (GAEBA) Committee in December 2016 at the Asian Corneal Conference in Seoul, South Korea. Development commenced in May 2017, concluding in February 2018. The process, designed similarly to that utilised by the Declaration of Istanbul Custodian group, invited at least one representative from every country, to participate in the survey (with default to regional representation should a country representative be uncontactable). GAEBA added to that design, sector advisors and additional representatives from larger multi-location eye bank organisations involved in exportation or sector capacity development programs. Participation was voluntary. Country representatives were selected by the 6 GAEBA partners. Regions without GAEBA representatives were selected with assistance from regional and national ophthalmological and civil societies. Remaining countries were sought through the sector network. Eye bankers, ophthalmologists (corneal, general and clinician scientists), tissue allocators/brokers and eyecare civil society professionals were approached. De-identified survey responses from voluntary representatives were utilised by the GBF Stakeholder Group (SHG) to develop the draft. The draft was subsequently provided to the survey respondents for their editorial comment prior to document finalisation by the SHG in January 2018, and ratification by XXXXX in February 2018. This process involved global and regional stakeholder representation and voluntary participation from 83 countries via 102 sector professionals, across all global regions – many whom are listed in this document.   • Legal Services If this Agreement is for legal services, this section is applicable. Contractor shall: (i) adhere to legal cost and billing guidelines designated by the JBE; (ii) adhere to litigation plans designated by the JBE, if applicable; (iii) adhere to case phasing of activities designated by the JBE, if applicable; (iv) submit and adhere to legal budgets as designated by the JBE; (v) maintain legal malpractice insurance in an amount not less than the amount designated by the JBE; and (vi) submit to legal bill audits and law firm audits if so requested by the JBE, whether conducted by employees or designees of the JBE or by any legal cost-control provider retained by the JBE for that purpose. Contractor may be required to submit to a legal cost and utilization review as determined by the JBE. If (a) the Contract Amount is greater than $50,000, (b) the legal services are not the legal representation of low- or middle-income persons, in either civil, criminal, or administrative matters, and (c) the legal services are to be performed within California, then Contractor agrees to make a good faith effort to provide a minimum number of hours of pro xxxx legal services, or an equivalent amount of financial contributions to qualified legal services projects and support centers, as defined in section 6213 of the Business and Professions Code, during each year of the Agreement equal to the lesser of either (A) thirty (30) multiplied by the number of full time attorneys in the firm’s offices in California, with the number of hours prorated on an actual day basis for any period of less than a full year or (B) the number of hours equal to ten percent (10%) of the Contract Amount divided by the average billing rate of the firm. Failure to make a good faith effort may be cause for nonrenewal of this Agreement or another judicial branch or other state contract for legal services, and may be taken into account when determining the award of future contracts with a Judicial Branch Entity for legal services.

  • Streets and Municipal Services 4.1 Off-Site Disturbance Any disturbance to existing off-site infrastructure resulting from the development, including but not limited to, streets, sidewalks, curbs and gutters, street trees, landscaped areas and utilities, shall be the responsibility of the Developer, and shall be reinstated, removed, replaced or relocated by the Developer as directed by the Development Officer, in consultation with the Development Engineer.

  • Good Offices, Conciliation and Mediation 1. Good offices, conciliation and mediation are procedures that are undertaken voluntarily if the parties to the dispute so agree.

  • HOME OWNERS ASSOCIATION The Purchaser acknowledges that a Home Owners Association (“HOA”) will be established to regulate, control and manage the common interests of the owners of properties in the development. The Seller will appoint and delegate any or all of its powers and duties in the management of the development to a Managing Agent of its choice. On registration of transfer the Purchaser will become a member of the HOA and be bound by its constitution. The Purchaser specifically acknowledges that he will be liable for levies plus VAT thereon, an estimate of which is detailed in Schedule “A”. The Seller reserves the right to install fibre optic communication or any other data and/or voice communication services in respect of the development as well as a network to serve each individual unit within the development. In the event that the Seller so elects to install the aforesaid communication and network, an additional levy per month shall be imposed upon the owners by the Home Owners Association for these services. The Purchaser specifically acknowledges that he/she will be liable for this additional levy plus VAT thereon, an estimate of which is detailed in Schedule “A”. The Purchaser herewith acknowledges that he has received and read a copy of the draft proposal of the Home Owners Association and understands the contents thereof.
