Working Out of Class Pay. In order for an employee to receive working out of class pay all of the following criteria must be met:

Working Out of Class Pay. When an employee is assigned to and performs significantly all of the duties of a higher allocated position in a classification whose salary range is at least five percent (5%) higher than the range of the employee’s regular classification, that employee shall be compensated at the step in the higher classification that provides an increase to the assigned employee of at least five percent (5%). Such assignment shall not change the unit designation or other benefits of the assigned employee except when a higher vacation accrual limit is in effect for the higher class. In such case, the higher vacation accrual limit applicable to the higher class shall be used. The assignment must be for over ten (10) consecutive working days. Such additional compensation shall begin on the first day of the pay period following the assignment to the duties of the higher position.
Working Out of Class Pay. When an employee covered by the provisions of this agreement is temporarily assigned in writing to and performs all of the duties of a higher vacant position in a higher classification whose salary range is at least five percent (5%) higher than the range of the employee's regular classification, that employee shall be compensated at the lowest step in the higher classification that provides an increase to the assigned employee of at least five percent (5%). The assignment must be over 15 consecutive working days. Such additional compensation shall begin on the sixteenth (16th) working day after the assignment to the duties of the higher vacant position.

Firefighters selected to and assigned to work as Acting Engineers shall be eligible for compensation pursuant to this section effective the first working day of the assignment. Engineers selected to and assigned to work as Acting Captains shall be eligible for compensation pursuant to this section effective the first working day of the assignment. Eligible Acting Captain shall complete sixteen (16) hours of the Fire Captain task book prior to being placed in an acting Fire Captain position. Concurrent with the sixteen (16) hour training program, individual shall complete at least ten (10) emergency calls during which the City will monitor their performance. The City will conduct Captain and Engineer examination on an as needed basis.
Working Out of Class Pay. Officers, Agents and Sergeants working out of class for a period of four or more consecutiveshifts) shall be compensated with the following premium pay; Officers and Agents working as an Acting Sergeant: 7% of base pay for all shifts Sergeants working as an Acting Lieutenant: 10% of base pay for all shifts Agents, and Sergeants fulfilling the role of an Acting Sergeant and/or Acting Lieutenant for individual shifts and/or a number of hours within a shift, shall not receive additional City of Palo Alto and PAPOA July 1, 2018 – June 30, 2021 compensation. Periodically working in this capacity shall be deemed a basic duty within an employee’s job description. In accordance with Government Code 20480, an employee assigned to work in an out-of- class appointment may not exceed 960 hours worked in the appointment within a fiscal year if the employee is appointed to an upgraded position or higher classification that is vacant during recruitment for a permanent appointment. This limitation does not apply to a position that is temporarily available due to a leave of absence.
Working Out of Class Pay. Employees may be assigned to perform the duties of a higher paid classification when the incumbent is not available for that work shift. An Out-of-Class assignment shall only be made by the supervisor or Department Director or his or her designee at the beginning of the work shift. An employee assigned Out-of-Class work shall receive five percent (5%) differential pay for all hours worked in the higher classification.

For working out of classification the employee shall be compensated at the step in the higher classification that provides an increase to the assigned employee of at least five percent (5%). As such, i f the 5% does not result in the employee reaching at least the first step of the higher salary range, the employee will be placed at the first step of the higher salary range. At one hundred eighty (180) days, the working out of classification assignment will be reviewed to determine whether it is appropriate for this person to continue working out of classification. Employees working out of classification or who are removed from Working out of Classification duty as a result of poor performance shall not be subject to unsatisfactory performance evaluation for their participation in said assignment. Participating employees removed from such assignment as a result of unsatisfactory performance shall instead be returned to their official job classification and duties. Failure to successfully complete a Working out of Classification assignment, as a result of performance, shall not have an impact on employee's official job classification or duties.
