WORKING OUT OF. CLASSIFICATION A promotional list shall be established for all bargaining unit officer rank classifications (e.g., Battalion Chief, Captain, and Lieutenant) as agreed to in Article 29. Candidates on the promotion eligibility list shall be utilized and have priority in working out of classification situations. Out of classification situations will fill as follows: Battalion Chief – highest ranked Captain on the eligibility list, most time in rank Captain, highest ranked Lieutenant on the Captain eligibility list, most senior Lieutenant on shift Captain – highest ranked Lieutenant on eligibility list, most senior Lieutenant on shift Lieutenant – highest ranked Firefighter on eligibility list, next on rotation list of FFIC for the shift SECTION 4: Employees shall be paid on a bi-weekly basis (Pay Period).

WORKING OUT OF. CLASSIFICATION (ACTING PAY) The Chief of Police may appoint police officers to perform work in other classifications where vacancies in these classifications exist due to terminations, vacations, attendance at school or seminars, sick leave, injury leave or other extended emergency leave usage, and/or special training. Any time a police officer is required to work by the Chief of Police, or their designee, in a rank with a higher rate of pay, the police officer shall be compensated at the minimum rate of pay for the rank in which they are acting or five percent greater than his/her regular base salary, whichever amount is greater, but in an amount not to exceed the maximum of the pay range for the acting position.
WORKING OUT OF. CLASSIFICATION A member appointed by the chief of police to work out of class on a temporary basis shall receive a 5% pay increase or the minimum starting pay of the position in the higher classification, whichever is higher, for the period of time the member is working out of class. This incentive will take affect when the member has been scheduled to be working out of class for more than seven calendar days.
WORKING OUT OF. Classification Bargaining unit members working temporarily in a higher class for more than fifteen (15) calendar days may be paid out-of-class differential pay. To qualify, an employee must be assuming the full and complete duties and responsibilities of the higher class. Said differential pay shall be applicable only when such vacancy has resulted from illness, an on-the-job injury or a job vacancy. Such differential pay shall begin only after the employee has performed the complete duties for fifteen (15) consecutive calendar days and shall be paid only for time actually worked. Out-of-class differential pay shall apply only to the days worked after the fifteen (15) consecutive calendar day period has been completed. The fifteen (15) consecutive calendar days must be worked within the span of fifty-two (52) weeks from the first day of duties performed in the higher classification in order for the employee to be eligible for the differential pay. Out-of-class differential pay shall be the difference between the employee’s regular wage and then to which the employee would initially be entitled should they be promoted to said higher class. Out-of-class differential shall be paid with the employee’s regular compensation and subject to the same benefits as the regular compensation. Complete records of such out-of-class differential work shall be submitted to the Department of Human Resources within two (2) weeks of having performed such work, on forms furnished by that department. The Police Chief shall be responsible for judicious observance of this section.

WORKING OUT OF. CLASSIFICATION SECTION 1. An employee temporarily assigned to work in a classification with a higher rate must be assigned work in said higher classification for more than one (1) day to be eligible to receive the pay rate of that higher classification for the period he or she was so assigned. Upon completion of such one (1) day worked, the employee shall receive the higher rated compensation for all time worked in the higher rated classification.

WORKING OUT OF. CLASSIFICATION Employees required to work in a higher classification for four (4) or more hours of the regularly scheduled shift shall be paid at the minimum of the higher classification or receive a seven (7%) percent increase to their current rate of pay, whichever is greater, for all hours so worked.
WORKING OUT OF. CLASSIFICATION (Continued) employees who are detailed from their assigned position to a position that qualifies for premium pay; and to pool personnel who possess specialized skills for which premiums are payable and are detailed to a company which utilizes such special skills. However, paramedics who are detailed to a Medic Company shall be eligible to receive the premium specified in Section 31.2 if they are detailed as a Paramedic for four (4) or more hours during any tour of duty.
