Common use of Work Schedule Changes Clause in Contracts

Work Schedule Changes. Any overall, long term change in work schedules will be discussed between the Employer and the Union Staff Representative and/or Union President prior to implementation. The Employer may change the regular starting and quitting times and the days worked in a week with five (5) work days’ notice prior to the effective date of the new schedule. The five (5) work day notice may be waived upon written mutual agreement between Management and the Union. Although reasonable warning will be given whenever possible, the five (5) work day notice provision will not be required for temporary individual shift assignment changes which may be made only to cover for the absences of another employee due to termination, resignation, vacations, or sick leave. Other than the reasons cited above, an employee’s work shift shall not be changed to avoid payment of overtime when an employee is called to work outside that employee’s regular work shift or called to work before the regular staring time or retained to work beyond the regular quitting time.
