Witness Pay Sample Clauses

Witness Pay. Employees who, as a result of their employment with CMBC, are compelled to attend an inquest or court on a subpoena requested or procured by Employer officials, or who are subpoenaed to appear for and by the Crown as a witness, will be reimbursed by the Employer for their regularly scheduled hours of work necessarily lost, at their regular straight-time hourly rate of pay. Any fees received by the employee for duties referred to in this Article shall be turned over to the Employer, excepting those received by the employee while on days off, Annual Vacation, or Statutory Holidays. Employees attending an inquest or court on an Employer requested or procured subpoena will be reimbursed for reasonable expenses when away from home. Duties under this Article which extend beyond one (1) week will necessitate a review of the employee's days off to assure some period of rest. Employees must report to work promptly after being released or excused by the courts and, in the case of Operators, be placed on the Spareboard in their own seniority.

Witness Pay. Time spent serving as a witness within the line of duty, or in a case related to the employee’s job, will be considered leave with pay. Whenever any full time permanent employee is required to be absent from work by a proper subpoena, issued by a court or commission legally empowered to subpoena witnesses, which compels their presence as a witness, unless the employee is a party or an expert witness, they shall be allowed the time necessary to be absent from work at their regular pay to comply with such subpoena, provided they deposits any witness fees, except mileage, with the County Treasurer.

Witness Pay. An employee who is compelled by a lawful subpoena to attend a legal proceeding during his or her working hours shall be excused without pay for the period of time necessary to comply with the subpoena. An employee shall notify supervision as soon as the employee becomes aware he or she has been or will be subpoenaed. If the subpoena relates to a matter involving Company business in which the employee is not a party, the employee will be excused with pay for the period of time necessary to comply with the subpoena.
Witness Pay. A Registered Nurse subpoenaed as a witness in court as a result of her/his performance of duties as a Registered Nurse of the Hospital will be paid for time lost from work as a result of such subpoena.
Witness Pay. A bargaining unit member subpoenaed by the Employers to appear in a judicial proceeding on a regularly scheduled work day will receive the difference between the applicable statutory witness fee and straight time earnings for each such day. The bargaining unit member must present a proof of Duty Statement issued by the Court to his/her manager.

Witness Pay. A leave of absence with pay not charged against leave time shall be granted for court appearances as a witness in any case connected with an employee's employment or whenever the employee is subpoenaed to attend any court proceeding relating to his employment or the Employer, provided there is no criminal act or gross negligence on the part of the employee, and provided further, that the court proceeding is not one in which the employee or the Association is an adverse party to the Employer. The employee shall reimburse the Employer any witness fee the employee receives for testifying.
Witness Pay. 5.2.1 Any employee required, during his otherwise off-duty time, to appear at the Maine District, Superior, or U. S. District Courts; Grand Jury; Liquor Commission hearings, or Secretary of State hearings to be a witness in any matter arising out of the performance of duty shall receive a minimum of four (4) hours pay at one and one-half (1-1/2) times their total hourly rate or may receive one and one-half (1-1/2) times their total hourly rate, whichever is greater, but not both. The increase in court pay will become effective on the first full pay week after execution of the contract.
Witness Pay. When an employee is absent from work in order to serve as a witness in a case in a court of law to which such employee is not a party either directly or as a member of a class and where such absence is in response to a legally valid subpoena, the employee shall be granted pay for those hours for which the employee is for such reason absent from work during the regular five day work week, less the fee or other compensation paid with respect to such service as a witness. Pay for absence due to service, as a witness shall be computed in the same manner as pay for absence due to jury duty as provided above. Pay for work time lost for jury duty or service as a witness as provided above shall together not exceed for any one employee a total of ten regular eight hour days in any one calendar year less the fee or other compensation paid with respect to such duty or service as a witness.
