Without prejudice to Article. II.3 any reference made to the Contractor’s staff in the Contract shall relate exclusively to individuals involved in the performance of the Contract.
Without prejudice to Article. 19.4 (Dispute Settlement - Consultations), a Party may request consultations with the other Party regarding any matter arising under this Agreement that affects financial services. The other Party shall give sympathetic consideration to the request. The Parties shall report the results of their consultations to the Sub-Committee. Consultations under this Article and consultations under Article 19.4 (Dispute Settlement - Consultations), that affect financial services shall include officials specified in paragraph 3 of Article 11.10.
Without prejudice to Article. 7.3, the Parties understand and agree that the piloting and line handling Services will be rendered directly by Service Provider as it has the technical capability and organization to perform them and that such Services will be performed by the named Service Provider autonomously without any technical direction by ALNG. Therefore, any liability arising out or connected with the provision of such Services should remain exclusively with the Service Provider in accordance with the relevant provisions of applicable law and any claim for such damages may be addressed and forwarded directly to Service Provider.

Without prejudice to Article. 11.1 above, in any case subject to any relevant provision under the Intercreditor Agreement, the Credit Agreement, the Revolving Guarantee or the Notes Documentation the relevant Financial Collateral shall be automatically released from the Pledge upon (a) any sale or other transfer by the Pledgor of any Financial Collateral that is permitted under the Credit Agreement, the Revolving Guarantee and the Indenture, or (b) upon the effectiveness of any written consent to the release of the Financial Collaterals from the Pledge pursuant to Section 9.02 of the Credit Agreement and Section IX of the Indenture or (c) in the other cases provided under the Indenture and the Intercreditor Agreement.
Without prejudice to Article. II.5.1, unless the Executive Agency requests or agrees otherwise, all communications or publications by the beneficiaries collectively or one of the beneficiary individually, which are related to the action, including conferences, seminars, videos, electronic communications or printed matter shall include the following statement: “This [insert appropriate description, e.g. publication, conference, etc.] arises from the project [insert project title] which has received funding from the European Union, in the framework of the Health Programme.” II – GENERAL CONDITIONS PART A – LEGAL AND ADMINISTRATIVE PROVISIONS
Without prejudice to Article. 27a(new) service providers shall ensure that procedures are in place so that the provision of services remains in conformity with the applicable accessibility requirements. Changes in the characteristics of the provision of the service, changes in applicable accessibility requirements and changes in the harmonised standards or in technical specifications by reference to which service is declared to meet the accessibility requirements shall be adequately taken into account by the service providers. In case of non-conformity, service providers shall take the necessary corrective measures to bring the service into conformity with the applicable accessibility requirements.
Without prejudice to Article. II.3.1, the European Union grants the beneficiary the right to make free use of the results of the action, including information and data, free of charge and as it deems fit, and, in particular, to display, reproduce by any technical procedure, translate or communicate the results of the action by any medium, provided it does not thereby breach the publicity obligations set in Article II.5, as amended by Article I.10.4, or existing industrial and intellectual property rights (including copyrights)".
Without prejudice to Article. 24, the EFTA Surveillance Authority may on its own initiative examine information regarding alleged unlawful aid from whatever source. T he EFTA Surveillance Authority shall examine without undue delay any complaint submitted by any interested party in accordance with Article 24(2) and shall ensure that the EFTA State concerned is kept fully and regularly informed of the progress and outcome of the examination.
