Withholding of Provisional Certificate. 14.5.1 If the Independent Engineer determines that the Bus Terminal or any part thereof does not conform to the provisions of this Agreement and cannot be safely and reliably placed in commercial operation, it shall forthwith make a report in this behalf and send copies thereof to the Authority and the Concessionaire. Upon receipt of such a report from the Independent Engineer and after conducting its own inspection, if the Authority is of the opinion that the Bus Terminal is not fit and safe for commercial service, it shall, within 7 (seven) days of receiving the aforesaid report, notify the Concessionaire of the defects and deficiencies in the Bus Terminal and direct the Independent Engineer to withhold issuance of the Provisional Certificate. Upon receipt of such notice, the Concessionaire shall remedy and rectify such defects or deficiencies and thereupon Tests shall be undertaken in accordance with this Article 14. Such procedure shall be repeated as necessary until the defects or deficiencies are rectified.

Upon receipt of such a report from the Independent Monitor[s] and after conducting its own inspection, if the Authority is of the opinion that the Project is not fit and safe for commercial service, it shall, within 7 (seven) days of receiving the aforesaid report, notify the Concessionaire of the defects and deficiencies in the Project and direct the Independent Monitor[s] to withhold issuance of the Provisional Certificate. Upon receipt of such notice, the Concessionaire shall remedy and rectify such defects or deficiencies and thereupon Tests shall be undertaken in accordance with this Article

Withholding of Provisional Certificate. 14.5.1 If the Independent Expert determines that the Project Network or any part thereof does not conform to the provisions of this Agreement and cannot be safely and reliably placed in operation, it shall as soon as practicable deliver a report to both the Contracting Authority and the Service Provider. Upon receipt of such a report from the Independent Expert and after conducting its own inspection, where the Contracting Authority is of the opinion that the Project Network is not fit and safe for service, it shall, within 7 (seven) days of receiving the aforesaid report, notify the Service Provider in writing identifying the Defects in the Project Network and shall be entitled to direct the Independent Expert to withhold issuance of the Provisional Certificate until such time as the Defects have been rectified to its satisfaction. Upon receipt of such notice, the Service Provider shall promptly rectify such Defects and following such rectification Tests shall be undertaken in accordance with this Clause 14. Such procedure shall be repeated as necessary until the Defects are rectified or remedied.
Withholding of Provisional Certificate. 14.8.1 If the Independent Engineer or the Independent Panel, as the case may be, determines that the Hospital Building or the Medical College Building or any part thereof or the Equipment or the Patient Care Areas, as the case may be, do not conform to the provisions of this Agreement and cannot be safely and reliably placed in commercial operation, it shall forthwith make a report in this behalf and send copies thereof to the Authority and the Concessionaire. Upon receipt of such a report from the Independent Engineer or the Independent Panel and after conducting its own inspection, if the Authority is of the opinion that the Hospital Building or the Medical college or the Equipment or the Patient Care Areas, as the case may be, are not fit and safe for commercial service, it shall, within 7 (seven) days of receiving the aforesaid report, notify the Concessionaire of the defects and deficiencies in the Hospital Building or the Medical College Building or the Equipment or the Patient Care Areas, as the case may be, and direct the Independent Engineer or the Independent Panel, as the case may be, to withhold issuance of the Provisional Certificate. Upon receipt of such notice, the Concessionaire shall remedy and rectify such defects or deficiencies and thereupon Tests shall be undertaken in accordance with this Clause 14. Such procedure shall be repeated as necessary until the defects or deficiencies are rectified.

Upon receipt of such notice, the Concessionaire shall remedy and rectify such defects or deficiencies and thereupon Tests shall be undertaken in accordance with this Article

If the Project In-Charge determines that the Project or any part thereof does not conform to the provisions of this Agreement and cannot be safely and reliably placed in commercial operation, it shall forthwith make a report in this behalf and send to the Concessionaire and withhold issuance of the Provisional Certificate or Completion Certificate, as the case may be. Upon receipt of such notice, the Concessionaire shall remedy and rectify such defects or deficiencies and thereupon Tests shall be undertaken in accordance with this Article 13. Such procedure shall be repeated as necessary until the defects or deficiencies are rectified.

Upon receipt of such a report from the Independent Engineer and after conducting its own inspection, if the Authority is of the opinion that the Heliport is not fit and safe for commercial service, it shall, within 7 (seven) days of receiving the aforesaid report, notify the Concessionaire of the defects and deficiencies in the Heliport and direct the Independent Engineer to withhold issuance of the Provisional Certificate. Upon receipt of such notice, the Concessionaire shall remedy and rectify such defects or deficiencies and thereupon Tests shall be undertaken in accordance with this Article
Withholding of Provisional Certificate. 14.5.1 If the Construction Supervisor determines that the Construction Works or any part thereof does not conform to the provisions of this Agreement and cannot be safely and reliably placed in commercial operation, it shall forthwith make a report in this behalf and send copies thereof to the ULB and the Concessionaire. Upon receipt of such a report from the Construction Supervisor and after conducting its own inspection, if the ULB is of the opinion that the Construction Works is not fit and safe for commercial service, it shall, within 7 (seven) days of receiving the aforesaid report, notify the Concessionaire of the defects and deficiencies in the Construction Works and direct the Construction Supervisor to withhold issuance of the Provisional Certificate. Upon receipt of such notice, the Concessionaire shall remedy and rectify such defects or deficiencies and thereupon Tests shall be undertaken in accordance with this Article 1414. Such procedure shall be repeated as necessary until the defects or deficiencies are rectified.

If the Independent Consultant determines that the Project or any part thereof does not conform to the provisions of this Agreement and cannot be safely and reliably placed in commercial operation, it shall forthwith make a report in this behalf and send copies thereof to MSRDC and the Concessionaire. Upon receipt of such a report from the Independent Consultant and after conducting its own inspection, if MSRDC is of the opinion that the Project is not fit and safe for commercial service, it shall, within 7 (seven) days of receiving the aforesaid report, notify the Concessionaire of the defects and deficiencies in the Project and direct the Independent Consultant to withhold issuance of the Provisional Certificate. Upon receipt of such notice the Concessionaire shall remedy and rectify such defects or deficiencies and thereon Tests shall be undertaken in accordance with this Article 14. Such procedure shall be repeated as necessary until the defects or deficiencies are rectified. Notwithstanding anything to the contrary contained in Clause 14.5.1, MSRDC may, at any time after receiving a report from the Independent Consultant under that Xxxxxx, direct the Independent Consultant to issue a Provisional Certificate under Clause 14.3.
