Common use of Withdrawal Right Clause in Contracts

Withdrawal Right. If, at any time, an Investor shall cease to hold at least 5.0% of the outstanding Paired Share Units, such Investor shall have the option to withdraw from this Agreement and shall be treated as if not a party hereto, other than with respect to those obligations contained in Section 8 with respect to the Company and such Investor, which shall continue. Any such withdrawal pursuant to this Section 10(o) shall be deemed to be made pursuant to the terms of this Agreement.
