Where the College Sample Clauses
The 'Where the College' clause typically defines specific actions, responsibilities, or rights that are attributed to the college within an agreement or policy. This clause may outline circumstances under which the college must act, such as providing notice, making decisions, or fulfilling certain obligations. For example, it might specify what the college must do if a student breaches a code of conduct or if a particular event occurs. Its core practical function is to clearly delineate the college's role and responsibilities in various scenarios, ensuring all parties understand when and how the college is expected to respond or intervene.
Where the College believes a vacancy needs to be filled quickly, the administrator may request the Selection Advisory Committee to use a quicker process. It is understood this will only occur in very rare situations where an accelerated process is essential to College operations. Where the Committee is unable to agree on an accelerated process, the administrator will determine the timing of the process, following consultation with the Committee. It is further understood that the administrator will attempt to resolve the dispute with the Committee, including calling an additional, special purpose meeting of the Committee to attempt to reach a resolution. The responsible administrator will put in writing the reasons for impasse and their decision.
Where the College has a Science Laboratory Technician at a Centre where University Transfer courses are offered, the Technician will take functional direction from the appropriate Science faculty member(s).
Where the College receives a written request from a faculty member for disclosure of any anonymous complaints or information which the College is holding about him or her, the College will disclose such information to the faculty member, except to the extent that it is authorized or required by law to refuse such disclosure.
Where the College provides residential accommodation for Learners, the College must inform the Department of the provision of such residential accommodation, must record this information on Get Information about Schools and will comply with the requirements of the national minimum standards for residential accommodation for Children in Colleges published from time to time by the Secretary of State under section 87C of the Children Act 1989.
Where the College requires the performance of work beyond the limits herein established, the College shall provide any such teachers with proper work facilities during such period.
Where the College. School or Division has identified a requirement that there is work to be performed at a higher level, it is the joint responsibility of the supervisor and the staff member to plan for a move to the higher classification level. This plan should form part of the normal Performance Development process, and will include:
(a) the development of a position description with the classification confirmed at the higher classification level; and
(b) an identification of the enhanced skills and/or qualifications required in the higher level position description and where necessary the establishment of a development plan to enable the staff member to acquire those skills and/or qualifications; and
(c) the establishment of agreed performance objectives to be achieved prior to the staff member being able to progress to the higher level; and
(d) specific timeframes in which the plan is required to be achieved.
Where the College terminates a Teacher’s employment the College will provide a minimum of seven (7) weeks’ notice during Attendance Days. The College may provide payment in lieu of all or part of the notice period.
Where the College terminates the Teacher’s employment (other than on grounds of misconduct or unsatisfactory performance) or gives notice (whether verbal or written) to a fixed-term Teacher that their contract will not or is unlikely to be renewed the College will not make deduction(s) under clause 14.4.1.
Where the College has notified the Employee of its intention of introducing technological change as outlined in Article 40.02, the parties will meet within the next thirty (30) calendar days to engage in consultation in a effort to reach an agreement on solutions to the problems arising from this intended change and on measures to be taken by the employer to protect the Employees from any adverse effects.
Where the College is not satisfied that a Teacher is effectively performing a position of responsibility, the position of responsibility may be reviewed in accordance with clause 58(Unsatisfactory Performance) or clause 59 (Misconduct) of this Agreement.
