Where Contractor. Affiliated Company or Sub-Contractor has, by notice in writing to the Commissioner General of the Guyana Revenue Authority, guaranteed the full and proper discharge by an Expatriate Employee engaged in Petroleum Operations of their liability to income tax under the laws of Guyana that expatriate employee shall be entitled to receive payment of the whole or any part of their remuneration in the country in which they are normally resident.

Where Contractor has during the Initial Exploration Period or, as the case may be, during the First Extension Period failed to fulfill its work and expenditure obligations under Article 4 in respect of that period but has made reasonable arrangements to remedy its default during the First Extension Period or, as the case may be, the Second Extension Period, Contractor shall be entitled to an extension subject to such reasonable terms and conditions as the Minister may stipulate to assure performance of the work.
Where Contractor receives a request by a third party for disclosure of information that Contractor believes to be Confidential Information and/or a trade secret of County, Contractor shall give written notice to County and County shall take immediate action to notify Contractor in writing whether County agrees to the disclosure or whether County opposes disclosure and shall take legal action to prevent such disclosure.
