When would I get my payment?. The Court will hold a Settlement Hearing on , 2020, at _.m., to decide whether to approve the Settlement. If the Court approves the Settlement, there might be appeals. When would I get my payment?. The Settlement cannot be completed unless and until several events occur. These events include final approval of the Settlement by the Court, approval of the Settlement by the Independent Fiduciary to the Plan, transfer of the Net Settlement Amount to the Plan, and calculation of the amount of the Settlement owed to each Settlement Class member. If objections are made to the Settlement or appeals are taken by objectors who oppose the approval of the Settlement, this process may take a long time to complete, possibly several years. There will be no payments if the Settlement Agreement is terminated. The Settlement Agreement may be terminated for several reasons, including if (1) the Court does not approve or materially modifies the Settlement Agreement, or (2) the Court approves the Settlement Agreement but the approval is reversed or materially modified by an appellate court. If the Settlement Agreement is terminated, the Class Action will proceed again as if the Settlement Agreement had not been entered into. The Settlement is not conditioned upon the Court’s approval of attorneys’ fees or the reimbursement of expenses/costs sought by Class Counsel, the Case Contribution Awards sought by the Named Plaintiffs, or any appeals solely related thereto.

All Proofs of Claim need to be submitted by , 2013. Once all the Proofs of Claim are processed and claims are calculated, Lead Counsel, without further notice to the Class, will apply to the Court for an order distributing the Net Settlement Fund to the members of the Class. THERE WILL BE NO PAYMENTS IF THE AMENDED SETTLEMENT STIPULATION IS TERMINATED The Settlement may be terminated for several reasons, including if: (1) the Court does not approve, or materially modifies, the Amended Settlement Stipulation in a way that Plaintiffs and Defendants do not accept; or (2) the Court approves the Amended Settlement Stipulation but the approval is reversed or materially modified by an appellate court. If the Settlement is terminated, the Action will proceed as if the Amended Settlement Stipulation had not been entered into. Calculations will be made as soon as practicable after the Settlement is completed, and a distribution will be made as soon as practicable after the calculations have been verified. Only Settlement Class members entitled to a distribution will receive correspondence when the distribution is made, because the costs of distribution are borne by the Net Settlement Fund, and sending notices to those who are not entitled to a distribution would deplete the Net Settlement Fund. Updates, when available, will be posted to the Settlement Website.

When would I get my payment?. The Court will hold a Final Approval or Fairness Hearing on , 20 , which may be rescheduled by the Court, to decide whether to grant final approval of the Settlement. If Judge Xxxxxxx X. Xxxxxx grants Final Approval, and there is no appeal of the Final Approval Order, the Order will become final by law in thirty days from the date of the entry of the Order. The Claims Administrator will attempt to pay all cash claims and Defendants will attempt to credit accounts within 30 - 45 days of the date the Order becomes final so long as individual amount of each claim can be determined. Also, there may be appeals. If so, the Final Approval Order does not take effect until those appeals are resolved. It is always uncertain whether and when appeals would be resolved, and payment under this Settlement cannot be made until the Final Approval Order is final.
When would I get my payment?. If you are eligible to participate in the settlement and timely provide the form described in Section 8 above, you will be sent a settlement check approximately 45 days after the effective date of the settlement. Before the settlement is effective, however, settlement class members must be given time to object to the settlement or opt-out, the Court must hold a hearing to consider the fairness of the settlement and grant final approval of the settlement, and any appeals of the court’s order granting final approval must be resolved.
