Warranty for Products. All warranties are personal to Customer and may not be transferred or assigned to a third-party, including an Affiliate of Customer. All warranties for Products are Facility specific and do not transfer if the Product is moved to another Facility of Customer, unless Illumina conducts such move. These warranties only apply to Products purchased under this Agreement.

Warranty for Products. Arrow warrants for a period of one (1) year from date of shipment to Customer that the Products are manufactured or assembled pursuant to the specifications and that the Products will be free from defects in workmanship. For Services, Arrow warrants for a period of ninety (90) days from date of shipment of any of the Products repaired that such Products will be free from defects in workmanship. With respect to any parts acquired by Arrow that are incorporated into the Products, Arrow agrees to pass through to Customer the warranty, if any, originally provided to Arrow by the manufacturer of the part subject to the terms, conditions and limitations of any such warranty. No warranty will apply to Products that are altered or subjected to misuse, negligence or abnormal stress. With respect to first articles, prototypes, pre-production units, Customer provided parts, test units or other similar products, Arrow makes no representations or warranties whatsoever. ARROW MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THE COMPONENTS, PRODUCTS OR ANY SERVICES PROVIDED UNDER THIS AGREEMENT, AND DISCLAIMS ALL OTHER WARRANTIES INCLUDING THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
Warranty for Products. If Customer has purchased Products, then this Section 3 shall apply. Unless otherwise provided on the attached Work Order or otherwise agreed to in writing by authorized AE personnel, AE warrants that: (a) new Products sold by AE will be free from defects in material and workmanship for 1 year from the date AE ships the Product, unless a different time period is specified on AE’s Work Order, in which case that time period will prevail, (b) certified used or refurbished Products sold by AE will be free from defects in material and workmanship for 180 days from the date AE ships the Product, and (c) exchange units delivered to Customer to replace a defective Product returned to AE by Customer will be free from defects in material and workmanship for the longer of (i) 90 days from the date AE ships the exchange unit, or (ii) the remainder of the defective and returned Product’s original warranty. Additionally, for any Product repaired or serviced under: (i) AE’s conversion and upgrade services, the Product will be free from defects in material and workmanship for 90 days from the date of conversion/upgrade, (ii) AE’s refurbishment service, the Product will be free from defects in material and workmanship for 180 days from the date of refurbishment, and (iii) AE’s standard repair service, any repaired component of the Product will be free from defects in material and workmanship for 90 days from the date of repair. AE's warranty shall not apply to any Products that are not installed or started in operation and tested in conformity with AE's published instructions, or to any Products which have been subject to misuse, negligence, or accident, or altered or repaired by anyone other than AE or AE's duly authorized agent. In all cases, AE has sole responsibility and discretion for determining the cause and nature of a Product defect, and AE's determination with regard thereto shall be final. Customer must notify AE of any breach of warranty within the applicable warranty period. The exclusive remedy for any breach of warranty shall be, at AE’s option, the repair of the Product or replacement of such Product with a Product of the same type, or the refund of the Purchase Price (defined below) for such Product. Warranty for Products. Limited Warranty; Warranty Period. Manufacturer warrants for a period of [number of months] months after the date of shipment of the Products by Manufacturer that such Products shall be free from defects in design, material and workmanship under normal use and service. Normal wear and tear does not constitute a warranty defect. In the event of breach of the limited warranty provided in this Section, Manufacturer’s only obligation under this warranty is to (and Distributor’s sole and exclusive remedy for breach of any warranty), at its option, to repair or replace all defective Products or parts, provided that Distributor has notified Manufacturer of the warranty defect in writing during the warranty period. Warranty for Products. Subject to the limitations contained in Article 41 herein, Bristol warrants that the Goods manufactured by Bristol provided hereunder will be free from defects in materials or workmanship under normal use and care. If the County discovers any warranty defects and notifies Bristol thereof in writing during the applicable warranty period, Bristol shall, at its option, repair or replace F.O.B. point of manufacture that portion of the Goods found by Bristol to be defective, or refund the purchase price of the defective portion of the Goods. All replacements or repairs necessitated by inadequate maintenance, unsuitable power sources, environmental conditions, lightning, accident, fire, misuse or abuse, improper installation, modification, use of unauthorized replacement parts, storage or handling, or any other cause not the fault of Bristol are not covered by this limited warranty, and shall be at the County’s expense. Bristol shall not be obligated to pay any costs or charges incurred by the County or any other party except as may be agreed upon in writing in advance by Bristol. All costs of dismantling, reinstallation and freight and the time and expenses of Bristol’s personnel and representatives for site travel and diagnosis under this warranty clause shall be borne by the County unless accepted in writing by Bristol. Goods repaired and parts replaced by Bristol during the warranty period shall be in warranty for the remainder of the original warranty period or ninety (90) days, whichever is longer.
