Waiver of Legal Rights. BY INITIALING IN THE SPACE BELOW, THE PARTIES ACKNOWLEDGE AND AGREE TO HAVE ANY DISPUTE ARISING OUT OF THE MATTERS INCLUDED IN THIS ARTICLE DECIDED BY NEUTRAL ARBITRATION AS PROVIDED UNDER ILLINOIS LAW AND THAT THEY ARE KNOWINGLY, INTENTIONALLY AND VOLUNTARILY WAIVING ANY RIGHTS THEY MAY POSSESS TO HAVE THE DISPUTE LITIGATED IN A COURT OR BY JURY TRIAL. THE PARTIES FURTHER ACKNOWLEDGE AND AGREE THAT THEY ARE WAIVING THEIR JUDICIAL RIGHTS TO DISCOVERY AND APPEAL EXCEPT TO THE EXTENT SUCH RIGHTS ARE SPECIFICALLY INCLUDED IN THIS SECTION. IF EITHER PARTY REFUSES TO SUBMIT TO ARBITRATION AFTER EXECUTION OF THIS AGREEMENT AND INITIALING BELOW, SUCH PARTY MAY BE COMPELLED TO ARBITRATE UNDER APPLICABLE ILLINOIS LAW. EACH PARTY’S AGREEMENT TO THIS SECTION IS VOLUNTARY. Waiver of Legal Rights. 1. I understand and accept that alpine skiing and snowboarding in its various forms is a HAZARDOUS SPORT that has many dangers and risks. I realize that injuries are a common and ordinary occurrence of this sport and that severe injury, including death, is an inherent risk of skiing/snowboarding. I expressly assume all risk associated with skiing and/or snowboarding including without limitation, the risks and inherent dangers associated with skiing/snowboarding and riding the lifts. These risks include, but are not limited to, changes in terrain, weather and snow surfaces, changes in lighting conditions, ice, moguls, bare spots, debris, fences, posts, trees, lift equipment and towers, rope tows, light poles, signs, buildings, roads and walkways, ramps, half-pipes, padded and non-padded barriers, jumps, rails, boxes, and other terrain features, grooming equipment, snowmobiles, utility or all-terrain vehicles, loading, riding and unloading lifts, collisions with other persons and other natural and man-made hazards and slips and falls on ice and snow. I agree to follow, and be bound by, Your Responsibility Code.

A FUN and informative camp for the younger camper. “This camp is designed to help younger players of all skill levels learn and understand the fundamentals of baseball. Players will be taught, drilled and have the opportunity to play games in a fun filled environ- ment.” - Head Coach Xxx Xxxxxxxxx The camp will provide a week of instruction by Frostburg State and other local coaches to ensure that campers have fun and learn at the same time. I agree that this Waiver, Release and Indemnification Agreement is to be construed according to the laws of the State of Texas and that if any portion hereof is held invalid, the balance hereof shall, notwithstanding, continue in full force and effect. By my signature below I acknowledge that I have read this entire document, that I understand its terms, that by signing it I am giving up substantial rights I might otherwise have, and that I have signed knowingly and voluntarily. I intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law. In executing this document, I intend for it to be binding on myself, my heirs, executors, administrators and representatives in the event of my death or incapacity.

Each of Parties acknowledge that it may hereafter discover facts different from, or in addition to, those which it knows or believes to be true with respect to the claims released pursuant to this Agreement, and all Parties that this Agreement and the provisions contained herein shall be and remain effective in all respects notwithstanding such different or additional facts or the discovery thereof.

Waiver of Legal Rights. Lessee waives the benefits of any law existing now or at any time during the term of this Lease and any extension thereof or thereafter giving Lessee rights or remedies as a result of the physical condition of the Premises or the Building and, without limitation, Sections 1932, 1933, 1941, 1941.2, 1942 and 1942.1 of the Civil Code of California and all right to make repairs at the expense of the City or to terminate this Lease as provided in those Civil Code sections or otherwise, except as expressly provided herein.
