VOLUNTARY PLANNING AGREEMENT. 25. A Voluntary Planning Agreement (VPA) at Attachment D was prepared and exhibited concurrently with the planning proposal and draft DCP. The public benefits that will be delivered are:
VOLUNTARY PLANNING AGREEMENT. The Planning Proposal was accompanied by letter of offer to enter into a draft Voluntary Planning Agreement (VPA) to provide the following contributions: • Dedication of 5% of the residential yield to affordable housing in accordance with Council’s Affordable Housing Policy 2013 (or provision of a monetary contribution to go towards affordable housing); and • Monetary Contribution for the provision of community infrastructure at a rate of $15,100 per net additional dwelling. Depending on the final design and approval process, this may equate to approximately $3.1-$3.3 million. On 26 October 2020, Council considered a report on this offer and resolved to endorse, in principle, the offer for the purposes of public exhibition. The detailed terms of the offer were subsequently resolved and the draft VPA was exhibited concurrently with the draft DCP. Council has recently been advised that the sites have been sold to a new land-owner. Should Council resolve to enter into the VPA it would need to be updated to reflect the new ownership details. The new owners have informally indicated a willingness to enter into the VPA and deliver on its commitments.
VOLUNTARY PLANNING AGREEMENT. One submission was received stating that the ‘compensation’ offered by way of a Voluntary Planning Agreement is not supported and shorter-term measures should not be used to address what is an over-development of the site. Council has previously objected to the Planning Proposal on planning grounds. It is important to note that the Voluntary Planning Agreement is not being accepted on the basis of it forming ‘compensation’ nor does it serve to make unacceptable planning outcomes acceptable. Rather, the VPA will help support the ongoing delivery of significant and much needed amenities and facilities for the existing and future community. The VPA is being offered in addition to the developer contributions levied under the North Sydney Local Infrastructure Plan. The VPA is a voluntary offer and if accepted, will deliver the provision of public benefits beyond what is legislatively required. In this regard, it is noted that the site has recently transferred ownership. The new owners, known as ‘Cbus Property R3 Pty Limited’, have recently provided written confirmation that it is their intention to honour the terms and extent of the VPA offer as exhibited. It is recommended that the VPA document be updated to reflect the new ownership details prior to any formal execution and registration of the document. Summary
