Violence Against Women Act. 1. The Landlord may not consider incidents of domestic violence, dating violence, sexual assault or stalking as serious or repeated violations of the lease or other “good cause” for termination of assistance, tenancy or occupancy rights of the victim of abuse.
Violence Against Women Act. MANAGEMENT may not consider incidents of domestic violence, dating violence or stalking as serious or repeated violations of the lease or other “good cause” for termination of assistance, tenancy or occupancy rights of the victim of abuse. MANAGEMENT may not consider criminal activity directly relating to abuse, engaged in by a member of a tenant’s household or any guest or other person under the tenant’s control, cause for termination of assistance, tenancy, or occupancy rights if the tenant or an immediate member of the tenant’s family is the victim or threatened victim of that abuse. MANAGEMENT may request in writing that the victim, or a family member on the victim’s behalf, certify that the individual is a victim of abuse and that the Certification of Domestic Violence, Dating Violence or Stalking, Form HUD-91066, or other documentation as noted on the certification form, be completed and submitted within 14 business days, or an agreed upon extension date, to receive protection under the VAWA. Failure to provide the certification or other supporting documentation within the specified timeframe may result in eviction.
Violence Against Women Act. In 2016, HUD published a Final Rule, 81 FR 80724, implementing provisions of the Violence Against Women Act (VAWA) in its housing programs. The purpose of the Final Rule is to protect applicants, tenants, and program participants in certain HUD programs, including HOPWA, from being evicted, denied housing assistance, or terminated from housing assistance based on acts of domestic violence, dating violence, sexual assault, and stalking, regardless of sex, gender, gender identity, or sexual orientation. HOPWA-assisted tenants may not be denied tenancy or occupancy rights solely due to any of the four criminal activities listed above if they were committed by a member of the household or any guest and the tenant or an affiliated individual of the tenant is the victim or threatened victim. If the perpetrator is the HOPWA-eligible member of the household, the remaining household will be allowed a grace period not to exceed one year and no less than nine months to apply for HOPWA assistance or find alternative housing. Housing assistance and supportive services will continue to be provided to remaining household members during the grace period. Grantee is required to add a VAWA Lease Addenda to any lease agreements and provide forms HUD 5380: Notice of Occupancy Rights Under the Violence Against Women Act and HUD 5382: Certification of Domestic Violence, Dating Violence, Sexual Assault, or Stalking and Alternative Documentation to tenants and applicants. Grantee is also required to develop an Emergency Transfer Plan to be used for victims of any of the four criminal activities listed above. The form HUD 5381: Model Emergency Transfer Plan for Victims of Domestic Violence, Dating Violence, Sexual Assault, or Stalking may be used as a model for this Plan. STRMU and Emergency/Short-Term Facilities are exempted from VAWA requirements except that no individual may be denied assistance, have their assistance terminated, or be removed on the basis of or as a direct result of the fact that the individual is or has been a victim or survivor of domestic violence, dating violence sexual assault, or stalking.

Violence Against Women Act. Development Owner must comply with: The notification requirements 24 CFR §92.359(c)(1), and 24 CFR §5.2005; The bifurcation of lease requirements 24 CFR §92.359(d)(1) and 24 CFR §93.356(c); The VAWA lease term/addendum and the emergency transfer plan, as further described in 10 TAC §10.613, as may be amended from time, 24 CFR §92.359(e) and 24 CFR §93.356(d); and The requirements apply for the duration of the Federal Affordability Period and the State Affordability Period (as defined herein).

Violence Against Women Act. (VAWA) In accordance with Title VI of Public Law 109-162 and the applicable sections of the U.S. Housing Act of 1937, as amended, the JCHA is committed to preserving and protecting the right to safe, affordable housing for victims of domestic violence, dating violence, sexual assault or stalking. The JCHA will comply with any provision of Federal, State or local law that provides the greatest protection for victims of these criminal acts. The JCHA will not deny admission to any applicant on the basis that they are or have been a victim of domestic violence crimes if the applicant otherwise qualifies for assistance or admission. If an applicant or resident is or has been a victim of domestic violence, dating violence, sexual assault or stalking, they must submit a form HUD-approved 50066 certification and other acceptable and official documentation (i.e., police report, or letters from Prosecutors office, victim services agency or medical professional, etc.) to the Asset Manager to verify the incident. The documentation must be received within 14 business days of notification to the JCHA that the individual is or has been a victim of these domestic violence crimes.
