Ventilation and Air Conditioning. Landlord shall provide capacity to the Premises for Tenant to distribute, heat, ventilation and seasonal air conditioning to the Premises for general office purposes. Tenant shall not make any alterations or additions to the ventilation and air conditioning equipment without the prior written consent of Landlord in each instance, which consent shall not be unreasonably withheld or delayed.

Ventilation and Air Conditioning. Landlord shall furnish to the Premises heating, ventilation and air-conditioning ("HVAC") in accordance with the Design Standards set forth in Exhibit D during Ordinary Business Hours. Landlord shall have access to all air-cooling, fan, ventilating and machine rooms and electrical closets and all other mechanical installations of Landlord (collectively, "Mechanical Installations"), and Tenant shall not construct partitions or other obstructions which may interfere with Landlord's access thereto or the moving of Landlord's equipment to and from the Mechanical Installations. No Tenant Party shall at any time enter the Mechanical Installations or tamper with, adjust, or otherwise affect such Mechanical Installations. Landlord shall not be responsible if the HVAC System fails to provide cooled or heated air, as the case may be, to the Premises in accordance with the Design Standards by reason of (i) any equipment installed by, for or on behalf of Tenant, which has an electrical load in excess of the average electrical load and human occupancy factors for the HVAC System as designed, or (ii) any rearrangement of partitioning or other Alterations made or performed by, for or on behalf of Tenant other than as constructed pursuant to (A) the Final Plans (as such term is defined in the Workletter), or (B) plans and specifications for Alterations proposed by Tenant which are approved by Landlord and where such approval is not conditioned upon the installation of supplemental HVAC Equipment. Tenant shall cooperate with Landlord and shall abide by the rules and regulations which Landlord may reasonably prescribe for the proper functioning and protection of the HVAC System.
Ventilation and Air Conditioning. 8.01 The Building heating, ventilating and air-conditioning systems servicing the Demised Premises shall substantially meet the following performance specifications: Inside Condition Cooling Season 75 degrees Fahrenheit Dry Bulb (hereafter “F.D.B.”) Heating Season 68 degrees F Outside Condition Cooling Season 91 degrees F.D.B./76 degrees Fahrenheit Wet Bulb (hereafter “FWB”) Heating Season 10 degrees F. Landlord shall be under no liability to Tenant if such performance specifications should not be able to be met prior to the said systems being balanced. Landlord, at its expense, shall maintain and operate such systems and shall furnish heat, ventilation and air-conditioning in the Demised Premises through such systems, subject to Article 9.07, in compliance with such performance specifications, during Regular Business Hours. If Tenant shall require ventilating and air-conditioning service or heating service at any other time other than Regular Business Hours (hereinafter called “after hours”), Landlord shall furnish after hours ventilating and air-conditioning service or heating service upon reasonable advance notice from Tenant, and Tenant shall pay Landlord therefore, as additional rent upon rendition of a xxxx, the air conditioning (“A.C.”) charge and the heating (“H”) charge. The A.C. charge and the H. charge shall be subject to adjustment upward from time to time.

Building Automation System HVAC controls shall consist of a fully integrated Building Automation System (BAS) incorporating direct digital control (DDC) for energy management, equipment monitoring and control. All shall include open licenses with access to both station and platform provided to Duke Realty at the highest administrative levels. Workbench and any other configuration/programming tools shall be embedded and licensed to Duke Realty. All application specific controllers (ASCs) shall be LonMark certified with all necessary configuration/programming tools or software provided and licensed to Duke Realty. Ventilation and Air Conditioning. Landlord represents that the HVAC system will be inspected and shall be in working order prior to Tenant move in date. Any repairs needed to the system prior to the move in date shall be at the Landlords expense. Landlord will only provide cooling for the front office area. Any cooling systems installed in the warehouse area shall be at the sole expense of the Tenant including all installation charges and repair costs. Landlord shall provide non-programmable thermostats. Landlord will maintain HVAC in the office areas to meet the industry standard of 77 degrees Fahrenheit inside if it is 91 degrees Fahrenheit outside; and 70 degrees Fahrenheit inside if it is 0 degrees Fahrenheit outside, and 60 degrees Fahrenheit in the warehouse when it is 0 degrees Fahrenheit outside.
