Variable Fee. (1) The customer shall pay to VGS a variable fee during the service period. This variable fee shall be determined based on the gas quantities (MWh) injected by the customer in the storage month concerned multiplied by the "variable fee" factor given in number 2.2 of the Annex "Capacities and Storage Fee" in €/MWh, if need be, by using the fee adjustment formula given in section (3).
Variable Fee. The Contractor shall receive an additional variable fee equal to the same amount of the fixed fee, as defined in Section 3.1 above, at the time the variable is to be paid. The variable fee shall be accrued at the end of each fiscal year of the Company and charged through an invoice by the Contractor. In case of partial achievement of the set objectives the Company will pay a proportional variable fee. The variable fee is based on the achievement of objectives to be set with the Company. These objectives will be negotiated yearly and are subject to formal approval of the Board of Directors of the Company.

Variable Fee. (a) The Permittee shall pay to the Port Authority a Variable Fee for each Annual Period during the Initial Term or the Renewal Term, as the case may be. The Variable Fee shall be determined by ascertaining separately for each Annual Period the amount which is the greater of (i) the Adjusted Gross Receipts Fee Component or (ii) the Gross Receipts Fee Component and subtracting from the amount thus determined the Minimum Fee payable for such Annual Period, including, without limitation, any applicable proration or equitable adjustment of such Minimum Fee. No other proration of the Variable Fee shall be applicable.
Variable Fee. (a) The Permittee shall pay to the Port Authority a WTC Variable Fee for each Annual Period during the WTC Term. The WTC Variable Fee shall be determined by ascertaining separately for each Annual Period the WTC Adjusted Gross Receipts Fee Component and subtracting from the amount thus determined, the WTC Minimum Fees payable for such Annual Period, including, without limitation, any applicable proration or equitable adjustment of such WTC Minimum Fees. No other proration of the WTC Variable Fee shall be applicable.
Variable Fee. For the period from July 1, 2024 through the Expiration Date, Consultant shall be paid at the hourly rate of $350 for Services actually performed by Consultant in response to written requests for such Services by Supervisor. Paragraph2 - Out of Pocket Expenses. Consultant shall be reimbursed for all reasonable out of pocket expenses incurred by Consultant in performing the Services pursuant to this Agreement provided Consultant receives written approval from the Supervisor prior to incurring such expenses.
Variable Fee. Variable Fee. In addition to the fixed fee, the Service Provider will receive variable fees based on the growth in the annual revenue stream from the Citroen account compared to the revenues from the twelve months preceding the date the Agreement takes effect. The maximum amount of variable fees that may be paid to the Service Provider will be 40% of the amount of his annual fixed fee, exclusive of tax. If the Citroen revenues remain at their level of the twelve months preceding the date the Agreement takes effect, the Service Provider may claim the maximum amount of variable fees. If the Citroen revenues are between 80% and 100% compared to what they were in the twelve months preceding the date the Agreement takes effect, variable fees from 0% to 40% will be due and payable on the basis of a linear increase.
Variable Fee. (i) In the event that Can-Am provides written notice requesting a Change in the scope, nature or type of Variable Services, the parties shall review such request, AMG shall inform Can-Am whether in the reasonable good faith opinion of AMG such Change will require AMG to hire additional Full-Time Allocated Personnel or to terminate any Full-Time Allocated Personnel, and AMG shall in good faith determine an adjusted Variable Fee which reflects the corresponding changes in its expenses, including any increase or decrease in expenses attributable to the hiring or termination of Full-Time Allocated Personnel. AMG shall use commercially reasonable efforts to provide for the requested Change, provided that the President of Can-Am or his designee, which designee shall be reasonably acceptable to AMG (the "Can-Am Designee"), approves of any fee adjustment and additional hiring of Full-Time Allocated Personnel prior to such Change.
