Vacation Qualifying Time. Vacation entitlement accrued to June 30 (inclusive) shall be taken prior to January 1 in the following year unless otherwise required by operational necessity, or unless requested by an employee and approved by the Employer. Requests by employees to take their vacation leave prior to a June 30th cut-off date shall be granted by the Employer unless otherwise required by operational necessity. If the employee terminates prior to the June 30th cut-off date then the Employer shall be reimbursed by the employee for such advanced vacation pay.

Vacation entitlement accrued to the anniversary date December 31 (inclusive) shall be taken prior to January 1st up to, or including December 31 in the following year unless otherwise required by operational necessity or unless requested by an employee and approved by the employer. Requests by employees to take their vacation leave prior to their anniversary date shall be granted by the employer unless otherwise required by operational necessity. If the employee terminates prior to their anniversary date then the employer shall be reimbursed by the employee for such advanced vacation pay.
