Common use of Vacation and Sick Leave Clause in Contracts

Vacation and Sick Leave. During the Employment Term, the Executive shall be entitled to paid vacation and sick leave (without loss of pay) in accordance with the most favorable plans, policies, programs and practices of the Company and its affiliated companies as in effect for the Executive at any time during the twelve (12) month period immediately preceding the Effective Date or, if more favorable to the Executive, as in effect generally at any time thereafter with respect to other peer executives of the Company and its affiliated companies.

Vacation and Sick Leave. During the Employment Termeach year of his employment, the Executive shall be entitled to paid vacation and sick leave (without loss of pay) in accordance with the most favorable plans, policies, programs and practices of the Company and its affiliated companies as in effect for the Executive at any time during the twelve (12) month period immediately preceding the Effective Date or, if more favorable benefits equal to the Executivemaximum available to any Company executive, as in effect generally at any time thereafter with respect determined without regard to other peer executives the period of the service that might otherwise be necessary to entitle Executive to such vacation or sick leave under standard Company and its affiliated companiespolicy.

In accordance with Company policies, programs and practices of Executive shall have the Company and its affiliated companies as in effect right to carry forward unused vacation days for the Executive at a calendar year to any time during the twelve (12) month period immediately preceding the Effective Date or, if more favorable to the Executive, as in effect generally at any time thereafter with respect to other peer executives of the Company and its affiliated companiesfuture calendar year.

During the Employment Termeach year of his employment, the Executive shall be entitled to paid vacation and sick leave (benefits under the Company’s policies equal to the maximum available to any Company senior executive, but in any event not less than 4 weeks per calendar year, determined without loss regard to the period of pay) service that might otherwise be necessary to entitle Executive to such vacation or sick leave in accordance with the most favorable plans, policies, programs and practices of the standard Company and its affiliated companies as in effect for the Executive at any time during the twelve (12) month period immediately preceding the Effective Date or, if more favorable to the Executive, as in effect generally at any time thereafter with respect to other peer executives of the Company and its affiliated companiespolicy.
